th e basis of th e U nited N ations
c h a rte r by Ju stice K eiller Mack-
ay of th e O ntario S uprem e court.
T he case grew out of a real
estate tran sactio n by th e W ork­
ers E ducational association, w hich
p lanned to build a m odel home
on O ’C onnor D rive here to be
raffled off to p rovide funds for
th e organization. The pro p erty
w as found to be covered by an
a n ti-jew ish restric tiv e covenant
w hich stip u lated th a t th e land
“w as not to be sold to Je w s or
persons of objectionable n a tio n ­
a lity .”
C ourt action w as bro u g h t about
by th e C anadian Je w ish congress,
rep resen ted by A tty. J. M. B e rn ­
stein, w hich objected to th e r a ­

tion.
“In my opinion,” he said, “n o th ­
ing could be m ore calculated to
create o r d eepen divisions b e­
tw een ex istin g religious and e th ­
nic groups in th e province or in
th is country, th a n th e sanction
of a m ethod of lan d tra n sfe r
w hich w ould p erm it th e seg reg a­
tion and co nfinem ent of p artic u la r
groups to p a rtic u la r business or

G ate C ity leads the nation in the
n u m b er of N egro businesses.
O f the 3,866 businesses studied
in 12 pivotal cities scattered
tth ro u g h o u t th e nation, Dr. Pierce
declared th a t A tlan ta N egroes
o p erate 843 businesses, th e h ig h ­
est n u m b er of any city studied,
w ith W ashington, D. C., follow ­
ing w ith 694 businesses.
T he m ost fre q u e n t businesses
am ong N egroes a re re stau ran ts
and b eau ty shops. Dr. P ierce said.
