NOTICE IS GIVEN that the
seller of real property, THE
HEIR(S) OF BETTYE JO
SCOFIELD, AKA BETTY JO
SCOFIELD, has received full
payment and performance
of the Memorandum of
Contract dated May 5, 1982,
as recorded in the Marion
County records on May 6,
1982, in Reel 280, Page 830,
between Melvin G. Scofi eld
and Betty J. Scofi eld (the
“Seller”) and Robert N.
Anderson and Glen P. Jones
for transfer or conveyance of
an interest in that certain real

but has failed or refused to

proper deed of conveyance.
Final payment was received

that Bettye Scofi eld died on

(b) The original instrument
creating the contract of sale
was an unrecorded land sale
contract, a memorandum of
which was created May 5,
1982, and recorded in the
Marion County Deed Records
on May 6, 1982, in Reel 280,
Page 830, between Melvin G.

(Seller) and Robert N.
Anderson and Glen P. Jones
(Purchaser).
Purchaser’s
interest was subsequently
transferred to Wayne E.
Mahaffey by that certain
Assignment

Contract
dated January 8, 1986, and
recorded January 8, 1986
in the Marion County Deed
Records at Reel 436, Page
270. Wayne E. Mahaffey’s
interest in the Property was
subsequently
purchased
via an unrecorded land sale
contract, a memorandum
dated January 12, 1995, and
recorded in the Marion County
Deed Records by Dennis M.
Oberto on January 13, 1995,
at Reel 1215, Page 683. The
land sale contract between
Wayne E. Mahaffey and
Dennis M. Oberto was fully
satisfi ed, as demonstrated by
the Warranty Deed recorded
in the Marion County Deed
Records at Reel 3033, Page
109 on December 12, 2009.
As such, Dennis M. Oberto
as Purchaser’s successor in
interest, is seeking to enforce
the fulfi llment of the land sale
contract referenced above
under ORS 93.285.
