W. Thebaud a motion for a new trial and set the case to come up at the Sep tember term of the court in this city. The special date will be fixed later. Judee Biegs had taken the case under advisement for a eek and on last Saturday Quite a number of in terested spectators had gathered to hear the Judge's decision. Judge Biees in announcing that a new trial should be given the defendant ex plained that in the court's opinion it was doubtful whether the defendant had acted in bad fsith, when he part ed with the notes in his possession, and he also mentioned that the court was in doubt as to the several points brought up in the case as well as one of instructions. Flint and husband have dur-, in the past few days ' filed a com-i plaint in the circuit court agalrsti that mining company. ' The complaint stated that the plain?, tiffs have been running a boarding house for men working in the minea of the Mormon Basin; that the de fendants ariteed to pay $200 for the . provements necessary on the build- ing and also agreed to pay $1 per day. for each employed miner for board while working for the defendant and ' for transients 50 cents per meal. The complaint goes on further to state that all the money had been , paid up to March 1, 1912 except $50,,. and that since then the amount due the plaintiffs has run up to $591. 19. R. G.
