Synopsis of "BE IT RESOLVED" Language of RESOLUTIONS PASSED When Constitution and Bylaws language is changed: Underscore = new language [ ] = deleted language CONSTITUTION AND BYLAWS (C&B #1) (Amended) AFL-CIO Delegates BE IT RESOLVED by the General Council of SEIU Local 503, OPEU: That Bylaws Article HI, Section 7 be modified as follows: (a) The following officers shah be automatic delegates to the conventions listed below: (1) AFL-CIO Conventions: All Statewide Officers, and all Central Labor Council delegates. (2) AFL-CIO COPE Conventions: All Statewide Officers, CAPE Chair, CAPE Secretary-Treasurer, and Political Directors and all Central Labor Council delegates. (b) If there are more delegates than slots, the delegates with the highest attendance during the past year at CLC meetings will be given first choice of delegate seats in their district with ties broken by pulling names.from a hat; ' , (c) If necessary, the remaining delegate or alternate slots shall be apportioned so that each district will receive at least one [additional delegate with the remainder of the] delegate designated based on membership population. The districts will be notified two (2) months prior to the convention of the number of credentials available to the district. In a single statewide announcement, n<*fication will be publicized in The Oregon Public Employee for nominations of delegates to the AFL-CIO Convention and the AFL-COPE Convention (held in alternate years) at least three (3) months prior to the Convention. Elections are to be held by each district at the next district meeting following publication in TOPE. Alternates shall be the candidates getting the next highest number of votes m the order of votes received. CONSTITUTION AND BYLAWS (C&B #2) (Amended) Candidate Endorsements and Expenditures BE IT RESOLVED by the General Council of SEIU Local 503, OPEU: That Bylaws Article XXI be rewritten as follows; The union's political action program with respect to candidate races and expenditures shall be administered by Citizen Action by Public Employees (CAPE) as outlined in its constitution and by laws who will make recommendations for endorsements to the Board of Directors for final action by a 2/3 majority vote of the Board. All financial matters of CAPE shall be kept separate from all other Union financial matters, and CAPE funds shall be kept separate Latino Caucus in solidarity with community-based organizations he SEIU Local 503, OPEU Latino Caucus B has been meeting vice president, Nancy Padilla, DHS Local 200, Hermiston; secretary, Laura Galaviz, DHS Local 200, McMinnville, and treasurer, Frances Martinez, A local of SEIU Local 503, OPEU may not endorse or give money to any candidate [for state office, for state senator, or for state DOJ Local 137, Portland. The Latino Caucus BE IT FURTHER RESOLVED that AP&P Article I, Section 6 be amended as follows:* Section 6. Voting on Political Items. ... a. Based on recommendations and information from Citizen Action by Public Employees (CAPE) or other appropriate sources the Board may vote to endorse or take no position on candidates for statewide elective offices and the State Legislature. Also, based on recommendations and information from CAPE or other appropriate sources, the Board may vote to endorse, oppose, or take no position on statewide ballot measures, or political issues. Any such action by the Board on political candidates, ballot measures, or political issues shall require a roll call vote' and approval by a two-thirds (2/3) majority of those voting. The position taken by the Board shall be communicated to the CAPE Administrative Committee and the general membership. * Amendment retained current language. CONSTITUTION AND BYLAWS (C&B #3) (Amended) Removal of External Organizing Duties from ADDs BE IT RESOLVED by the General Council of SEIU Local 503, OPEU: That Bylaws Article X, Section 7(h) be removed from the duties of the ADDs: [Shall serve as chairperson to the District's volunteer organizing committee working in conjunction with the statewide co-chairs of the volunteer organizing committee and the external organizing department of SEIU Local 503, OPEU, to facilitate and foster success and increase involvement within the membership to assist in the efforts to bring the benefits of a union to unorganized workers.] BE IT FURTHER RESOLVED that AP&P Article II, Section 9, Subsection 5 be amended as follows: 5. MEMBER/LOCAL UNION ORGANIZING COMMITTEE (MOC). a) The Union will maintain a Member/Local Union Organizing Committee to design and support the structure necessary for mem bers to work on behalf of the Union for periods of up to one (1) year while on leave or release from their current employment. The Board of Directors will fund a regularly scheduled training session for MOC/LUOC members to be done by organizing staff, Mem ber /Local Union Organizers (on paid time) who have had the training previously, and SEIU resources when and where available, b) This committee will indude Union leadership as well as rank-and-file. c) This committee will develop a statement of purpose, a timetable, and a proposed funding base necessary for the operation of an ongoing Member/Local Union Organizing Committee through which local members can work to organize non-represented people in the labor force. d) This committee will have the following goals: 1. To recommend local union organizing goals, subject to Board approval. 2. To develop a strategic organizing plan for the Union. 3. To assist in creating member organizing committees so that the Union has trained volunteer organizers to support its organizing. 4, To work with members to set up district organizing teams that can be-called upon to help in external organizing activities aroulTd the state whether within their districts or not. District team members have at least one organizing opportunity per quarter to take part in external organizing activities and training. 5. To maintain a current list of trained members, schedule trainings, and a record of members' participation be presented to the Board quarterly. [4]6. To evaluate and revise an organizing plan on a regular basis. CONSTITUTION AND BYLAWS (C&B #5) (Amended) Decertification/Disaf filiation Efforts BE IT RESOLVED by the General Council of SEIU Local 503, OPEU: That any member who institutes or is part of a decertification/ disaffiliation effort or who solicits membership in a different labor organization will be removed from all steward or officer positions they hold, subject to the provisions of Article XVII of the SEIU International Constitution and Bylaws. Officers will be considered to have instituted or participated in disloyal activities if they solicit or distribute a petition or literature advocating disaffiliation, decer tification or another labor organization; sign such a petition; vote for disaffiliation, decertification or another labor organization in a local Executive Board meeting; or take any other actions to advocate that the local should no longer be affiliated with SEIU Local 503, involved, please contact: Xochilt Esparza 503/379-6327 x219, Padilla 541/481-9482 since July, 2002. BE IT FURTHER RESOLVED that Bylaws Article I, Section 7 be amended as follows: Section 7. Willful violation of any provision of the Union Constitution and Bylaws shall be cause for removal from any office held and the memtier will be restricted from running for any steward or officer position for two years, subject to the provisions of Article XVH of the SEIU International Constitution and Bylaws. BE IT FURTHER RESOLVED that any member who is part of more than one decertification/disaffiliation effort or efforts to solicit membership in another labor organization within two (2) years, subject to the provisions of Article XVH of the SEIU International Constitution and Bylaws, will not be able to run for any steward or officer position for five (5) years, and that Bylaws Article XVH, Section 6 be amended as follows: Section 6. Violation of Responsibilities of SEIU Local 503, OPEU Membership. Members who are found to have violated any of the responsibilities of SEIU Local 503, OPEU membersliip are subject to reprimand, probation, suspension, or expulsion from member ship. Any member who is part of more than one decertification/disaffiliation effort or solicitation of another labor organization within two (2) years will not be able to run for any steward or officer position for five (5) years, subject to the provisions of Article XVII of the SEIU International Constitution and Bylaws. EMPLOYEE REPRESENTATION (ER #1) Higher Education Leadership Council BE IT RESOLVED by the General Council of SEIU Local 503, OPEU: That Bylaws Article XIV, Section 7, be amended as follows: Section 7. The Councils of the Union are Local Government, Local Presidents, Professional Employees, SEIU Local 503, OPEU Women's, Stewards, Higher Education and Men's. BE IT FURTHER RESOLVED that AP&P Article n, Section 9(c) be amended as follows: (c) Councils. The councils of the Union are: Local Government, Local Presidents, Professional Employees, Women's, Stewards, PAGE 8 THE OREGON PUBLIC EMPLOYEE Higher Education and Men's. These councils are established to further conununication and the principles of unionism within these groups. Unless otherwise provided for in the Constitution and Bylaws or AP&P, all councils shall consist of one (1) member from each district and a chairperson who is appointed by the Union President, subject to approval by the Board of Directors. Any council with a corresponding SEIU International or SEIU Local 503, OPEU conference (i.e., Women's Conference) will be responsible for recruiting at least one (1) participant from each district to attend. BE IT FURTHER RESOLVED that AP&P Article n, Section 9 be amended to add a new subsection as follows: 7. Higher Education Council. The Higher Education Council shall consist of at least one elected member from each of the seven campuses in the Oregon University System, and a chairperson will be selected by the members of the council. This Council will meet on a regular basis to develop strategy, discuss issues to be resolved or put forward during negotiations with OUS, develop system-wide campaign actions in concert with the Bargaining Team, to enable and develop coalition building on each campus, and (in response to input from the Bargaining Team) create and publish flyers, press announcements, website announcements, and bulletins for distribution on campus. This Council will also meet to build solidarity throughout the system. Its primary mission will be to organize and motivate members on each campus to act as one- In addition, the Council will be advised by the Higher Ed Coordinator organizer and will meet and confer with the Higher Ed Bargaining team regularly during the contract campaign to enable direct communication and report on the progress of the campaign on the indiyidual campuses. The Council could be asked to develop the agenda for conferences to better inform and motivate membership, especially during contract campaigns. MEMBERSHIP AFFAIRS (MA #2) Statewide Of ficer Elections BE IT RESOLVED by the General Council of SEIU Local 503, OPEU: That Bylaws Article VI, Section 4(e) be amended as follows: (e) All duly nominated candidates shall be given equal access to all Union meetings and conferences, provided that the opportunity to make campaign presentations shall be consistent with the agenda and protocols for such meetings and conferences. All candidates for a statewide office shall be invited to attend at least one District meeting per district sometime between the opening of statewide candidate nominations and the time statewide officer election ballots are mailed to members. r
