A state o fficer or em ploye who shall fa il to com ply w ith any provision o f this act or o f an y rule, regulation or order thereunder shall be su b ject to all penalties and rem edies now or hereafter provided by law for the failu re o f a p u b lic officer or em ploye to do an act required or him by law . The com m ission m ay m aintain such action or proceeding at law or in equity as it considers necessary or appro priate to secure com pliance w ith this act and its rules and orders thereunder. Section 28. The records o f the depart m ent, except such records as the rules m ay require to be held confidential fo r reasons of public p o licy, shall be public records and shall be open to public inspection, sub je c t to regulations as to the tim e and m an ner of inspection w hich m ay be prescribed by the com m ission. Section 29. N o em ploye of any division or the com m ission shall use his o fficia l authority or influ ence to fu rth er the cause o f any p o litical p arty or candidate for nom ination or election to p u b lic o ffice . No person shall solicit from any em ploye o f any division or the com m ission any m oney, in flu in ce, service or other valu ab le thing to fu rth er the cause o f any p o litical party or candidate fo r nom ination or election to public o ffice. N o em ploye of any division or o f the com m ission shall seek or accept nom ination, election or appointm ent as an o fficer o f a p o litical p a r ty ,' club or organ ization, or serve as a m em ber of a com m ittee or any such club or organization, or be a candidate for a p olitical o ffice. Section 30. 1. N o person shall m ake any false statem ent, certificate, m ark, rating or report w ith regard to any test, certifica tion, or appointm ent m ade under any pro vision o f this act, or in any m anner com m it or attem pet to com m it any frau d p re ven tin g the im partial execution o f this act and the rules. 2. N o person shall, directly or indirectly, give, render, p ay, o ffe r, solicit or accept any m oney, service or other valu ab le con sideration for or on account o f an y ap pointm ent, proposed appointm ent, prom o tion or proposed prom otion to, or any ad vantage in, a position in the classified ser vice. 3. N o em ploye of the departm ent, e x am iner or other person shall defeat, de ceive or obstruct any person in his righ t to exam ination, e lig ib ility , certification or ap pointm ent under this act, or fu rn ish to any person an y special or secret inform ation for the purpose o f e ffectin g the rights or prospects of any person w ith respect to em ploym ent in the classified service. Section 31. 1. A n y person who w ilfu lly violates an y provision of this act or o f the rules shall be g u ilty o f a m idem eanor, and shall, upon conviction, be punished b y a fin e o f not m ore than fiv e hundred dollars ($500) or b y im prisonm ent in the county ja il for a term not exceeding one year, or b y both such fin e and im prisonm ent. 2. A n y person who is convicted o f a m is dem eanor under this act shall, fo r a period o f fiv e years, be ineligible fo r appointm ent to or em ploym ent in a position in the state service, and if he is an o ffice r or em ploye o f the state, shall be deemed g u ilty o f m alfeasance in o ffice and shall be subject to fo rfe it o f his o ffice or position. Section 32. The adm inistrative expenses and costs of operating the departm ent o f civil service shall be paid b y the various divisions o f the state governm ent. To es tablish an equitable devision o f the costs, the am ount to be paid by each division shall be determ ined in such proportion as the service rendered to each division bears to the total service rendered b y the d e partm ent. The c iv il service departm ent shall, at such tim es as it m ay deem proper, deter m ine the expenses incurred during a given period and upon approval b y the state budget director the departm ent shall ren der to each state division affected thereby an invoice for its pro rata share o f such expenses, and such division hereby is a u thorized and directed to p ay such invoice as an adm inistrative expense of such d iv i sion from funds or appropriations available to the division in the same m anner as other claim s against the state are paid. Su ch am ounts paid to the civil service de partm ent shall be deposited in the state treasury as h ereinafter provided. For the purpose o f providing fund s for the paym ent of expenses in carrying out the provisions of this act there hereby is appropriated the sum o f ten thousand dol lars ($10,000)-, w hich sum shall be placed in a separate account in the general fund in the state treasury to be know n as the c iv il service departm ent account. A ll m oneys received by the c iv il service departm ent under the provisions o f this act shall be deposited in the state treasury to the credit o f the c iv il service departm ent account, and such am ount as m ay be neces sary, and no m ore, hereby is appropriated out o f such c iv il service departm ent a c count for the paym ent of a ll expenses in curred in the adm inistration of this act. The secretary o f state hereby is author ized and directed to audit a ll d u ly approved claim s w hich have been incurred in p u rsu ance o f law and the foregoing appropria tion and to draw his w arrants on the state treasurer fo r the paym ent thereof, payable out o f the c iv il service departm ent account o f the general fun d . Section 33. I f and w hen this act has m et the standards required fo r a m erit system o f personnel adm inistration b y the social security board of the U nited States, it shall supersede any other m erit system provisions o f the unem ploym ent com pensa tion com m ission; the state board o f health; the state board of h igher education, actin g b y and through the university o f Oregon m edical school, and the state p u b lic w e l fare com m ission. A t such tim e the com plete m erit system s adm inistering the p er sonnel o f these divisions shall be tran sfer red to the departm ent o f civil service es tablished b y this act. Su ch transfer shall be su b ject to the jo in t approval o f these agencies and the social security board o f the U nitd e States and shall include o ffice space, fu rn itu re, furnishings, files, records, register, and any and all other property. A n y and all unused m oneys budgeted for the m erit system s o f the state board of health, the state p u b lic w elfare com m ission and the state unem ploym ent com pensation com m isison, shall th ereafter be transferred to the fund for the operation of the dep art m ent o f c iv il service. I f the funds thereby transferred are less than the division’s pro rata share o f the cost o f operation, the d iv i sion shall pay such additional sum neces sary to equal such cost, but if the am ount is in excess of its share, the excess am ount (Continued on Page 40)
