Section 13. 1. In accordance w ith rules
adopted by the com m ission, the director
shall establish and m aintain divisional re
em ploym ent, reem ploym ent and em ploy
m ent and prom otion lists.
2. D ivisional reem ploym ent lists and re
em ploym ent lists, shall contain the nam es
o f persons who have been regular em
ployes, and who were separated from their
positions for reasons other than fa u lt or
delinquency on their part. The order in
w hich nam es shall be placed on divisional
reem ploym ent or reem ploym ent list shall
be established b y the rules, in w hich m erit
ratin g and length o f service shall be taken
into account. The term o f e lig ib ility o f
such candidates shall be determ ined b y the
com m ission, but shall not exceed two years
from the date of their separation fro m the
service in w hich th ey earned reem ploy
m ent rights. The com m ission m ay strike
the nam e o f a person fro m a divisional
reem ploym ent list or a reem ploym ent list,
if it find s, after givin g him notice and an
opportunity to be heard, that such person
is not qualified to perform satisfactorily the
necessary duties.
3. Prom otion lists and em ploym ent lists
fo r the various classes o f positions in the
classified service as are found necessary or
desirable to m eet the needs of the service,
shall contain the nam es of persons who
have been fou nd qualified for appointm ent
to a p articu lar position b y test. The eligi-
bles shall be ranked in order o f their ra t
ings earned in the tests given for the p u r
pose of establishing such lists.
4. V eterans o f any o f the wars o f the
U nited States who have su ccessfully com
pleted all phases of an -entrance test shall
be allow ed preference on the list estab
lished as a result o f an entrance test.
P reference is hereby defined to m ean
that w henever a w ar veteran, as defined
b y Oregon law , com petes in any entrance
test conducted b y the civil service board,
he or she shall be accorded fiv e points,
and if such veteran has a service connected
disab ility or not less th an 10 per cent,
recognized and certified as such b y the
U nited States veterans’ adm inistration, he
or she shall be accorded another fiv e points
in addition to h is or her passing grade
earned in such test. R atings shall be based
on a scale o f 100 points.
5. The com m ission m ay extend the period
of elig ib ility of any list b y order m ade
before the expiration o f the list, b u t the
e lig ib ility o f a list shall not be extended
to a total o f m ore than two years. The
com m ission m ay consolidate or cancel pro-

m otion lists and em ploym ent lists as the
needs of the service m ay require and as
authorized by the rules. A prom otion list or
em ploym ent list w hich hgs been in force for
six m onths or m ore shall be deem ed can
celled upon the establishm ent o f a new
prom otion list or em ploym ent list, as the
case m ay be, for the sam e class o f positions.
Section 14. 1. In accordance w ith the
rules adopted b y the com m ission, the d i
rector shall from tim e to tim e conduct en
trance tests and prom otion tests as neces
sary fo r establishing em ploym ent lists and
prom otion lists.
2. The tests shall be com petitive and shall
be o f such character as to determ ine the
q ualifications, fitness, and ab ility o f the
persons tested to perform the duties o f the
class o f positions fir w hich a list is to be
established. T hey m ay be w ritten, oral,
p h ysical, or in the form o f a dem onstration
of skill, or any com bination o f such types.
The tests m ay take into consideration edu
cation, experience, a p t i t u d e , capacity,
know ledge, character, p h ysical fitness and
other qualifications, as enter into the deter
m ination of the relative fitness o f the app li
cants.
3. N o question in any form 'of application
or in any test shall be so fram ed as to
elicit any inform ation concerning the po
litica l or religious opinions or a ffiliatio n s
o f any applicant, nor shall any inq u iry be
m ade concerning such opinions or a ffilia
tions and all disclosures thereof shall be
discountenanced. N o discrim ination shall be
exercised, threatened or prom ised b y an y
person in the em ploy o f an y division or
the com m ission against or in favo r o f any
applicant, eligible or em ploye because o f
his race or religious or p olitical opinions or
a ffiliatio n s; provided, how ever, th at the
foregoing shall not prevent any inquiry
as to w hether the applicant, em ploye or
eligib le has any beliefs inim icable to the
governm ent or who advocates or is a m em
ber of an organization w hich advocates the
overthrow or resistance b y force o f our
form o f governm ent.
4. The com m ission shall establish rules
sp ecifyin g the q ualifications for adm ission
to any test. Su b je ct to the rules, adm ission
to tests shall be open to a ll persons who
appear to possess the required qualifications
and m ay be la w fu lly appointed to a posi
tion in the class for w hich a list is to be
established and who p ay the fee, if an y,
prescribed b y the rules.
5. The director shall give public notice o f
each test at least two w eeks in advance of
such tests in the m anner specified b y rules
adopted b y the com m ission.
6. E ach o fficia l notice of a test shall state
the duties and p ay of positions in the class
for w hich the test is to be held, the q u ali
fications required therefor, the tim e, place
and m anner o f m akin g application for a d
m ission to such test, the estim ated num ber
o f vacancies to be fille d , and other in fo r
m ation considered pertinent.
