M O T IO N # 2 3 - Delores Pigsley moved to approve the Conceptual plan, begin fond raising and work on the long range plan for the Cultural Center. Seconded by Pat Morrel. Motion approved 9-0-0. ATTO R N E Y R E P O R T The City of Lincoln City is appealng the BIA decision, the Tribes response Is due June 2nd. The c ity is also appealing under the land conservation. It w il go into federal court if it goes to tN s level. W e have the final document for the Comstock Agreement, Craig wil have the document in the next couple of days. W e w il only provide $ 2 miffion for liability insurance. Craig received a letter from PCL and the amount negotiated for finalizing. They are reviewing the final issues with the gaming center. Tim Viles, Facilities M anager and Dietm ar w il be meeting next w eek to finalze everything. John Berry keeps teWng them everything Is fine. Council agreed that he can not speak for toe Tribe. Craig received the information on toe W yant property to complete the purchase of the property. Craig is drafting legal opinions on retro-cession and criminal jurisdiction as directed last month. The parking lot application has been submitted with toe city o f Lincoln City, there is a hearing in Lincoln City on the 22nd o f May. Craig said w e are paying $9 ,0 0 0 a month for toe parking from Hemstreet. Craig is going to try for a waiver. They need to show how they are going to meet all of the requirements. TN s is the sam e day as our Gaming Compact negotiations. The 9th Circuit hearing is submitted. D e e announced that Joan Richardson is in the hospital with triple bypass surgery, one o f her concerns has been the showers. Jessie said the P o w W ow Committee has designated the men’s as a women’s restroom also. The portable units w il be brought in with showers and toilets for the men. Council w il discuss IN s tomorrow. TRIBAL C O U N C IL C O N C E R N S Geneva Johnson asked about what rights do spouses have if they are married to a Tribal Member? She has had several complaints about people abusing the cigarette breaks. They get to work and run out and smoke. It is still going on. Nelsen said the health issue is a IH S funded program. Spouses should be covered under the Oregon Health Plan. O h Drug and Alcohol and a minor is involved, both parents can receive services. Nelsen w il check oh the smoking issue. Denise has a concern over toe “Duck" paper given to Council, she thought it was not very professional. She had a concern about the Donna Swanon, Headstart issue, has not been cleared up. Nelsen said it is being followed up on. Denise would ik e to have the authority o f out of state travel given back to Tribal Council. It was asked to be changed, and it was not done. MOTION # 27 - Denise Peterson moved to amend the Operations Manual to change the out of state travel back to Tribal Council. Seconded by Pat Morrell. Motion approved 9-0-0. Clfford C a s e asked about the Eagle Enterprises proposal. Dennis is working on tNs. Nelsen said we need to have a legal opinion on tois. JoAnn is very happy with toe Natural Resources Department. BOXING-Bob Witzel He is the treasurer for the International Boxing Federation. You w il need to form your own boxing commission, otherwise toe state w il step in. The State tried to step in on Tribes in California. H e provided professional boxing rules and regulations for guidance. You wil need two or three people for a Commission. You need to keep control of your own games. The State wil not be able to set in and regulate you. H e suggested using performance bonds. You wil need insurance coverage. The president o f thé federation recommended not letting the Stete in. If you join the Federation for $ 1 5 0 you get toe rales and regulations and toe ratings on each boxer. You would be better off seffing your own tickets and pay after the fight. MOSS AD AM S - Mary C ase Lille had asked M ary to address Council on issues o f concern. Liffie had asked about the general fund regarding expenditures and how the Tribe reimburses the account M ary provided a handout to Council.
