Thurs., Dec. 9, 1971 (Sec. 2) SANDY (Ore l POST - 7 Charges made Summer home owners say tax illegal D William David Childers, 46, of Rt 2, Box 422C, Boring, was arrested Nov. 28 and lodged in Rocky Butte Jail on two traffic violations. Sheriff's reports said he was charged with driving under the influence of intoxicating liquor and driving with a .15 or higher level of alcohol in his blood stream. Bail was set at $610. Clackamas County is named as one of eight defendants in a suit charging illegal taxation of recreational homes located on national forest lands. Plus the county assessors office states that county residents in the Sandy- Hoodland area can expect an increase in property assessments and taxation starting this spring. According to Jack Boyd, chief appraiser for the county, there w ill be a general increase in taxation throughout the county. He also stated that if the Summer Home Owners suit is upheld the county w ill lose some tax revenues. The suit involves homes built on federal land mainly in the Mt. Hood National Forest. However, the operator who pays close attention to society's rules and regulations, and to current concerns being ex pressed by society, stands a good chance of staying out of court, the extension specialist believes. W illrich has five points which he feels w ill minimize the possibility of court litigation. Provide an adequate distance between an odor source and points where an odor could offend others unreasonably and constitute a nuisance. An adequate buffer zone for odor dissipation should be provided in all directions, not just in the direction of prevailing winds. Use waste management methods that minimize the release of offensive odors, particularly if the buffer zone is inadequate for normal odor dissipation by natural con ditions. The association complains that such taxation of these homes is unconstitutional because it results in double taxation and violates the 14th Amendment. It also contends that taxation by the state discrim inates against the homeowners because they already hold special permits to own the homes, for which they have paid a fee, 25 per cent of which is paid to the counties in which the national forests are located.
