As It grew pro gressively worse, he began to suffer delusions and came to believe that Richard Roe In tended to k ill him. So he took a pistol and killed Richard Roe. He was brought to tria l for m urder, and his attorney at tempted to defend him on the ground that he was Insane and should be sent to a mental hospital rather than to the elec tric chair. The psychiatrists who tes- tlfed at Doe’ s tria l were asked whether Doe could distinguish right from wrong. They said he could, that he knew killing was wrong and forbidden by law, but that he killed anyway be cause he believed Roe would k ill him unless he killed Roe firs t. Is Doe legally Insane? Should he be convicted of murder or be sent to a mental Institution? This case Illustrates the cur rent argument over the legal test for Insanity. The test used In Oregon to day Is whether or not a c rim inal defendant knows right from wrong. If he does, he Is sane. If he does not, he Is Insane. Thus Is the so-called M ’ Naghten Rule, which originated In Eng land early In the nineteenth cen tury. The critics of the M ’ Naghten Rule often cite the report of The Royal Commission on Cap ita l Punishment, which said the rule Is based ” . . . on an entirely obsolete and mislead ing conception of the nature of Insanity, since Insanity does not only, or p rim a rily , affect the cognitive or Intellectual fac ulties, but affects the whole personality of the patient, i n cluding both the w ill and the emotions. An Insane person may therefore know the nature and quality of his act and that It Is wrong and forbidden bylaw ,and yet commit It as a result of the mental disease.” Among the principal critics of the M ’ Naghten Rule are psy chiatrists. They say It falls to take note of the progress of science over the century and a half since It was formulated. The Joe Doe case Illustrates the problem. Should the Inquiry Into his mental condition stop when we learn that he can distinguish right from wrong? O r should we go on and con sider the fact that his mental disease led him to k ill, even knowing It was wrong, because he actually believed Roe was going to kill him. What do you think? If you have any views on the subject, communicate them to your legislators.
