U n a b le to d e f e a t th e I n d ia n n a t i o n s o n th e b a t t l e f i e l d , th e U n i t e d S t a t e s c a r e f u l l y r e s p e c t e d t h e i r s o v e r e i g n t y in e a r l y p o s t - r a t i f i c a t i o n s t a t u t e s . T h e s e s t a t u t e s , a n d th e v a r i o u s t r a d e a c t s o f 1 7 9 0 , 1793 a n d 1 7 9 6 , r e s p e c t e d th e j u r i s d i c t i o n o f I n d ia n g o v e r n m e n t s o v e r t h e i r c i t i z e n s an d p ro p e rty . A s th e n i n e t e e n t h c e n t u r y p a s s e d i n t o a p e r io d o f e x p a n s i o n b y th e U n ite d S t a t e s , m u c h of t h i s s e n t i m e n t f e l l to s t a t e a n d f e d e r a l c h i c a n e r y . t r e a t i e s a n d a g r e e m e n t s w e r e o f te n w r i t t e n a n d i n t e r p r e t e d t o th e d i s t i n c t d i s a d v a n t a g e o f th e I n d i a n s . W h en I f i r s t b e g a n to p r a c t i c e la w o n th e P i n e R id g e S io u x R e s e r v a t i o n in S o u th D a k o ta , I s p e n t o n e a f t e r n o o n d r i v i n g a r o u n d in a v a n w ith s o m e n e w f r i e n d s w h o w e r e t e l l i n g m e of t h e L a k o ta h i s t o r y . T h e In d ia n s , I w as t o l d , th o u g h t th e w h i t e s h a d i d e n t i f i e d t h e m s e lv e s a s " l i a r s , " in s te a d of " la w y e r s ." T h e I n d ia n s , I s u s p e c t , k n e w w h a t th e l a w y e r s w e r e d o in g , b u t w e r e e i t h e r m i l i t a r i l y u n a b le o r u n w i l li n g to r e s o r t to w a r f a r e . T h e la w s w e r e c o n t i n u a l l y u s e d to p l a c e a f a c a d e o f d e c e n c y u p o n p o l i c i e s l a c e d w ith r a c i s m . In 18 17, C o n g r e s s p a s s e d th e M a jo r C r i m e s A c t, w h ic h m a d e c r i m i n a l la w s a p p l i c a b l e w ith in I n d ia n t e r r i t o r i e s e x c e p t w h e r e t o d o s o w o u ld v i o l a t e t r e a t i e s o r w h e r e th e c r i m e c h a r g e d w a s b y a n I n d ia n a g a i n s t a n o t h e r I n d ia n . T h i s e n c r o a c h m e n t u p o n s o v e r e i g n t y s t e m m e d f r o m t r e a t i e s b e tw e e n th e U n ite d S ta te s a n d c e r t a i n n a tio n s , b u t th e a c t w as n o t l i m i t e d t o t h o s e I n d ia n s w h o h a d a g r e e d . T o d a y , th e a c t a p p l i e s to a l l I n d i a n s , a n d n o A m e r i c a n c o u r t h a s e v e r r e c o g n i z e d th e l i m i t a t i o n s t h a t s h o u ld h a v e b e e n a p p l i e d to i t s sco p e. T h e c o u r t s h a v e a l s o c o n s i s t e n t l y f a i l e d to r e s t r i c t th e a c t s c o m m i t t e d b y th e U n ite d S ta te s , e v e n w h en th e y w e r e b la ta n tly u n c o n s ti tu tio n a l an d im m o ra l. O n e o u t r a g e o u s i n v e n t i o n o f th e S u p r e m e C o u r t w a s th e " p o l i t i c a l q u e s t i o n d o c t r i n e .
