T To apply, contact volunteer coordinator Nicole S eattle C ouple S eek C hild ’ s B irth R ecord I n a letter made public April 5, Lambda Legal is urging the Oklahoma Health Department to issue an accurate birth certificate to a girl who was adopted by two gay men. “The health department does not have author ity to decide who gets a birth certificate or who is a legal parent,” attorney Brian Chase said. “The law clearly requires state officials to issue this birth certificate. It’s both unlawful and unconscionable to withhold this vital document because of anti gay prejudice against a child’s parents.” Gregory Hampel of Seattle is urging the Oklahoma Health Department to issue a birth certificate for his 2-year-old daughter, Vivian Lambda became involved in the case when the former health commissioner refused to issue an accurate birth certificate reflecting both of the child’s parents. Vivian, 2, has lived with Gregory Hampel and Edmund Swaya in Seattle since shortly after she was bom in Oklahoma. Oklahoma Attorney General W.A. Drew Edmonson, at the request of the ex-commission er, recently issued an advisory clarifying the matter. It explains that under the U.S. Consti tution and state laws, the department is required to issue accurate birth certificates for children legally adopted outside Oklahoma, including those raised by same-sex couples. Lambda won a similar case involving a les bian couple in Vermont who adopted a baby from Mississippi.
