The position of the California court,
according to notice received today, has
resulted in release through habeas
corpus of the four McDunal .3, two
women and two men, who were held in
Dos Angeles on the charge of mur-
dering W. H. McNutt, a Spokane real
estate dealer, whose body was found
buried under the ashes of a fire on a
ranch 40 miles from Spokane. Th«
Los Angeles judge also refused to
honor the signature of Grant Hinkle as
assistant secretary of state.
This is the first time the authority of
the acting governor or assistant sec­
retary of state has been questioned,
since both are expressly empowered to
discharge the full duties of their re­
spective departments. Governor Hart
will not return from Walla Walla un­
til tomorrow or Monday.
Autocracy in Morth Dakota
Under the North Dakata plan the
state will absolutely control all indust­
ry, commerce, enterprise and initiative.
Nothing which opposes the non-partisan
league will be allowed to stand. As an
instance—the state government of
North Dakota selects one newspaper
in each county as the only one in which
public notices and legal notices can be
published. Tnis is already operating to
drive out of business all the press
which refused to bow to the Townley
will. It will enable the non-partisan
leaguers to feed their propaganda to
North Dakota people and force them
to swallow it. It is easy to see how
completely the opposition to non-parti­
san league principles will be throttled.

Oregon CitJ( proposing a constitutional
amendment to fix the legal rate of
interest in Oregon at 4 per cent or
money after it becomes due, and pro­
viding that on Contract not more than
5 per cent may be charged, now has a

by Attorney General Brown Saturday.

Patrick Donegan, a former well-
known resident of this city, died at the
home of his daughter at Stockton, Cal­
ifornia, Saturday, October 18. 1919.
Mr. Donegan was born in Ireland,
May 16, 1832, and came to the United
States when quite young, settling at
this city in 1853, he followed his trade
of blacksmith for many years and was
known to nearly everyone In Jackson
county. In 1910 he removed to Cali­
fornia, where he resided up to the time
of his death.
He is survived by nine children: five
sons and four daughters. His wife
died about 11 years ago
Funeral was held in this city Tuesday

ver, the young man who had been loat
in the mountains west of this city since
last Sunday, came out at Marshfield
yesterday morning. He had fol'owed
down one of the branches of Coos
river, until he came to a settlement.
Fearing that he would never reach
civilization, he had written a note on
his collar, and left it along his trail.
This was found by the searching
party.

apparatus belonging to the Marcon
station in this city before it was taken

station, where it was securely boxed
