THE RECALL OF JUDGES In his message to congress vetoing the resolution admitting New Mexico and Arizona to statehood, Presi dent Taft makes an excellent argument against the recall provisions as applied to county and state judges. Whether the president was justified in vetoing the resolution or not may be open to discussion, but there is no question about the soundness of his views upon the recall as applied to judicial officers and the message in question should have a careful persual by every thinking American. We have space for a short extract only: “The recall is devised to encourage quick action, to lead people to strike while the iron is hot. Supporters of such a system seem to think it would work only in the in terest of the poor, humble, weak and oppressed; that it would strike down only judges supposed to favor corpora tions who are affected by the corrupting influence of the rich. Nothing is further from the ultimate result. “Themotive it would offer to unscrupulous combina tions to seek control of politics and the control of judges is clear. Those having the best opportunity of rousing the majority of the people to action under sudden impulse would profit by the recall. Do they not include those hav ing money enough to employ firebrands and slanderers in a community, stirrers-up of social hate? “Would not self-respecting men hesitate to accept judicial office with such a sword of Damocles hanging over them? What kind of judgments might those on an un popular side expect from a court whose judges must make decisions under such legalized terrorism? The character of judges would deteriorate to that of trimmers and time servers, and independent judicial action would be a thing of the past.” Gather ye watermelons while ye may. “Alas” seems to be the proper motto for Alaska.
