An ordinance to regulate the plac ing of poles, wires, conduits and oth er conductors and appliances on the streets, avenues and alloys of the city of Medford, Oregon, and to pro vide for the issuing of permits there for. The city of Medford doth ordain us follows: Section 1. Kvery person, co-pnrt-ner.-htp or corKruliou, who f-hall now or hereafter have I lie right to place any poles, wires, conduits or other conductors or appliances for telephone, telegraph, messenger serv ice, electric lighting, electric power puiose.s or any other purpose upon any of the stroots, avenues or alleys of the city of Medford, shall, before placing any such poles, wiros, con duits or other conductors or appli ances upon any such street, avenue or alley, cause to be prepared a plan showing the nature and character of such work, the size and height of each pole or other appliance, the number of wires to be eventually car ried thereon and shall designate on said plan the particular place on said street, avenue or alley at which it is proposed to place every such pole or iipliance of whatever nature, giving distances from the center of said street, avenue or nil ey as platted urd laid out and from the nearest -trcet intersection, and phall file said ;t!an with the rectrder of said city mid secure from smh recorder a per mit for such work as hereinafter pro vided. Section 2. Immediately upon re ceipt of any such plan the recorder hall notify (he sttctt commissioner of said city thereof, and said street commissioner shall within three days thereafter investigate the said plan and the jwrtion of the street, avenue or alley so proposed to be occupied by said poles, wires or other appli ances, and may call to his assistance in case he requires the same the services of the city engineer. Said street commissioner shall within throe days after the filing of any such plan, file with the recorder a report, thereon, together with his recomtnon- I dntion as to whether said plan should j be approved, modified or rejected, i with his reasons therefor, and any ( Information which he shall deem of value in assisting the council to pnss on said plan. At the next meeting of the council held more than three days jfiftor any such plan is filed as afore said, the council shall take up and forthwith dispose of said plan, either by approving, modifying or rejecting j the same, and the council shall not j delay action on said plnn by reason 'of the failure of the street coinmis j Honor to file a report thereon as hereinbefore required. The council may, at its option take up and dis pose of any such plan, although the s:nne lin been on file les than three jdays. Section it. Kvery person who shall plnce any pole, wire, conduit or other conduc tor or appliance upon any street, avenue or alley of the city of Med ford. or who shall direct the same to be done or in any manner assist in so doing without securing a permit therefor as herein provided, shall be irmlty of a violation of this ordi nance, and upon conviction thereof shall be liable to a fine of not more than fifty dollars rr by imprisonment tor a term not exceeding thirty days.
