MEDFORD MIL PablUbad Kvenr Friday Horaing. A. 5. BLITON. JTrx7RD,OitKCior' April 21, 1905 rT4t laud fraud trials commenced MUnuohiy at Portlutid with th argu Kwott.f couiihoI for both sides on the jgfeo if "abatement" on to red by a xmmxivr of those arraigned on indict xcuoft for defrauding or attempting Uu jftfrauri the government. The cmpanmt caino up on tlie plea made ftp "5'"-'iMl H' Mitchell, and the aonttm t&fit' the defeiiHe is that the grand 2jyn$ which found the indictments xuaiKgaI, inasmuch as some of the 2RTRf were not qualified, and that Olbtnrt Attorney Honey was not, at flMetiae, quuliiled to act as such, and tttouhtiense further demands that the y&iM&iA abatement be triod before a 'pry. Among those interested are 'J&nSjHr Hermann, J. N. Williamson, CDtatH. Ntckell, U. S. oommlsaioner audi publisher of the Southern Ore ttPUKMV and many others. Each of MhsB-pfoas must stand or fall aojoord niapta the decision made in Senator dUifc&eii'B case. Every one of these ritotanfeinta havo expressed their abll ifgr to triumphantly exonerate them unhnp from the obargos brought :i4(Euiaot them, but now put. in a plea ak abatement on purely technical jjpcfmi&ia, which, if they win, will not bto exoneration, but like the old fiiatttfe rerdiot, "not proven," be as wb of a moral disgrace as a convio titanv simply lacking the attendant wawafcinent. Judgo IJeuuett, for the hhhi, contends for the right to Hie fcltaftuu in abatement in a Fed oral arnnrt, and argues that if it raises a uyr-tbtuni of fact the defendant Is en H&ijdt to a trial thereof by jury ; that tftA cfaws not raise a question of fact, 4lkm the issues must bo decided by kttoi tourt. Judge Bollinger scemod to awftuatu by frequent interruptions to t&iKKKumont that aplea in abatement ijfrxuuY&iy a permit to challenge the IRxiitf jury wliei-o there has been no uOn)ttuuity, and says the question Mutt Kites of added importance by rea iaat aS the fact that the case could qNMw In triod on its meiits if separ-.totr-jAwui in abatemont, are to be given jfOTff trial.
