RULE SUMMARY: The Certification Program is financially insolvent as current fees are insufficient for the long term fiscal health of this program. Additionally, in the case of service provided on behalf of the USDA, the Department has a Cooperative agreement in which it agrees to charge fees as established by the USDA. This increase is necessary to bring the department into compliance with that agreement. This proposed rule would amend rules governing general inspection fees to remove reference to Certification and Third-Party audit services and adopt new provisions governing Certification and Third-Party audit services to a new section. Newly adopted provisions would increase fees for Certification and Third-Party audit services. Certification fees for the USDA National Organic Program (NOP), USDA Good Agricultural Practices/ Good Handling Practices (GAP/GHP), and USDA Produce Good Agriculture Practice (GAPs) Harmonized Standards would increase each as follows: Increases the four-hour minimum service charge from $92 to $108; Increase travel time rate from $92 to $108 per hour; increases the annual application fees for USDA – NOP from $250 to $1,000 for first-time applicants, and from $100 to $750 for renewal applications. Global Food Safety Initiative (GFSI) certification services would change from $300 per certificate and/or per site, to an hourly fee of $150 per hour with a four-hour minimum; establishes a travel time rate of $150 per hour. Fees for other audit based services would be established through contract. Mileage, lodging and per diem would continue at the current rates as established by the Department of Administrative Services and would apply to all of these services. These services are voluntary, fee for service certifications that are available upon request and aid the Oregon agriculture industry in marketing products nationally and internationally.
