Tho league said Mr. Hoover had dono "virtually nothing" to replace vessels which have passed or are reaching the limit of effective age. and that "while Europe smolders and Asia is ablaze, the president Insists that wo cannot now afford even to start moderate measures for building up our fleet to treaty terms." Today's attack was tho most con spicuous one by the league since last October when Its president, William Howard Gardiner sowed the seeds of a notable controversy with the White House by a statement charging Mr. Hoover, among other things, with ex hibiting "abysmal Ignorance" on naval matters. That Incident ended with the verdict of a special board, chosen by tho president to investi gate) tho charges, which upheld the chief executive and said the league statement contained many inaccur acies, false assertions and erroneous conclusions. The league disputed the finding, however. Today's state ment also was Issued over Gardiner's signature. In tho form of a printed 17-pnge pamphlet entitled: "The treasury deficit and a treaty navy." April 7 VP) The $75,000 salary for president Hoover and the $15,000 salary for Vice President Curtis in the next fiscal year was approved today by the house In the Independent offices supply bill. Wllkerson told a senate committee today he had rejected the agreement under which Al Capone was tolead guilty because the gang ster wanted to bind the court on the sentence to be Imposed. Tho circumstances of the Capone case were explained In a letter to the senate Judiciary sub-committee considering his nomination for cir cuit court. He satd counsel for Capone claimed to have an agreement with govern ment prosecutors that the gangster's plea of guilty was not to stand unless the court followed the proposed rec ommendation for a sentence of ai years. Attorneys for the government denied they had made such an agree ment, Wllkerson said. "The hearing did not reach the point where the court was required to decide whether or not it would adopt the government's suggestion," he wrote. "Defendant was allowed to plead not guilty, and afterwards to with draw that pica and be heard upon a demurrer to the indictment. "The defendant never had an agree ment with the court as to the sent ence to be imposed. He objected to proceeding with the hearing to de termine what action would be taken on the government's recommendation and never claimed that there was anything connected with the pleas of guilty or their withdrawal which precluded the court from imposing the sentence which was imposed after the trial."
