band and wife domiciled. (n Idaho in
rendering separate income tax returns
may each report as gross income one
half of income which, under Idaho
law becomes simultaneously with its

that the attorney general would ren-

to the attorney general until just re
cently, when Mr. Aker ascertained
that Idaho taxpayers were not entit

perty returns, without a specific opin
ion from the attorney general on the
Idaho community property law, which
was secured finally by Mr. Aker,
through the intercession of members
uf the Idaho' delegation in congress.

lowing conclusions with relation to
the application of the Texas commun
ity property law to the rendering of
returns by husband and wife: J 1 '
"The earnings'of husband nnd wife
domiciled in Texas are community in
come und such husbund and wife in
rendering separate income tax re
turns, may each report as gross in
come one-half, the total income from
separate property, except the in
crease, rents and revenues from land

"The income from community prop
erty as defined by the Texas stuluto,
is community income, and, therefore,
husband and wife domiciled in lexas,
in- rendering separate income tax re
turns, may each report as gross in
come one-hulf. the total income frum
such community property."
Should He Careful.
While the Idaho community prop
erty luw is in many respects ttimilni
U the Texas law, nnd the same rules
and regulations will undoubtedly .ap
ply to tlie reporting of income by hus
bund and wife domiciled in Idaho, yet j
taxpayers should be fully advised as
to the proper method of making their
returns, before filing them with the
collector for Idaho, who may fee ob
liged to return the snme to the tax
payer if not prepured correctly, and
this may result in much confusion nnd
trouble, both to the revenue officials
and the taxpayer, it is said. The as
sistance of experts in these matters
is, therefore, advisuble.
This decision will result in the snv-
ing of thousands of dollars to Idaho
taxpayers, -who mny avoid the henvy
additional tax of 8 per cent, and the
surtax rates on their ' individual re
turns by making separate returnB of
husband and wife, particularly where
the joint net income exceeds $0,000,
thereby rendering the income taxable
many cases ut only the minimum
rate of 4 per cent. The exemptions
of husband and wife and for children
apply as heretofore, but the proper
method to be followed is to divide the
exemptions equally between husband
and wife, in preparing the return.
