Tak Inn of testimony In tho damage suit filed by cx County Judge Messick closed yesterday nftninoon. Mr. Rand then opened the argument, de voting the rest of the morning to re viewing his side of the ease and palming Judge Messick as being persecuted. In his forceful and eloquent man ner, Mr. Kunu tnrew niinseu nuo niE subject. Mr. Rand took tho posi tion that the affidavits concerning Judge Messlck's alleged Improper re lations with hlB ward, Qlenna Iteconl, were In themselves actionable and that if nothing more had been as serted outsldo the affidavits by the circulators Btill the contents of the affidavits wore libelous and defam atory; that their direct effect was to deprive Judge Messick of public es teem and confidence and to injure him Irreparably both as a citizen and lawyer and as the bolder of an office of trust and confidence. Judge Clifford for the defense was oo less vigorous In his manner. lie dunled emphatically that the defend ants wcro actuated by personal mal ice or sought ulterior purposes, Claiming thut thefi actions at all times were open 'and abovo board; OI11C1AI. A right that is said to tlnglo with realism soon will be seen In the lat est Trlanele-Kuy Deo play, "The Lit tle Brother," by Louis Zellner, in which Thomas II. Ince presents his new star, Enid Hennett. It Is one of those flBtlc encounters that may be seen any day in any big city about the time the "extras" arrive hot from the press, and the newsies strugglo for the best corners and lie In wait for the possible customer. Enid Dennett in the title role of this production portrays a little girl of the slums who, thinking to add to the family Income, dons boys' clothes buys a few papers and plunges Into the maelstrom of the city's busiest section with disastrous results. All of the older newsboys resent the presence of tho new "kid" and a free-for-all fight ensues. In the rough nnd tumble scramble Miss Dennott Is said to hold her end up every mlnnto and only yields at the last moment to overwhelming odds. This picture and Fatty Arbuckle'n newest comedy will be shown at the Arcade today and tomorrow. Fatty's comedy Is called "Fatty at Coney Island," and has been pro. noimced as being his best two reel comedy he hns produced. that Judge Mslclc wai Riven nn op portunity ro refi;i nil charges agalnit him. and f-Hinp. ia this lie was offered in 'nppoi tuftiiy to resign office, which he refused to do. The defense claimed that the words of the Ualdwln nffldnvlt were not and nre not actionable In themselves because they do not charge the plaintiff with the conimlfsion of any crime but merely constitute an official slate menl.under oc.lh by Mrs. Baldwin. S-T-A-R A 95 Lesson - m Tomorrow, Saturday, the first of ficial war pictures to be shown in La Grande will ho presented at the Star Theatro for the one day only. These pictures were taken by the Cinematographic Division of the Fiench army and are absolutely au thentic. The three reel picture "In the Wako of the Huns" was used in Port land during the last Liberty loan drive by the committee and caused much Interest. They v.ere taken in the battle region after Von Hindi nburg's ! "victorious retreat." The ruin und desolation in the Somnie, the Oie, and on the Ahno are pictured In all their appalling tragedy. Shattered vllages, blown up bridges, devastated orchards nnd every Imaginable form of vandalism that may be inflicted upon mere property nre shown. Oc casional peasants arc seen aniong the ruins und this gives a human touch to the views.- Armies on the inarch and big guns in action are also shown. The other reels are "With the Stars and Stripes in France," and show "our boys" at work and play.
