Salem, Or., May 18. Holding thut
lu franchise between a city and public
I utility could only be altered by the
j mutual consent of the parties, Circuit
j Judfre Galloway - today pronounced
j invalid an order recently issued by
j the public service commission, in-
creasing the rates of the Western
Telephone company of Woodburn.
J ' The commission increased the
; rates after another company had
i merged with the Western Telephone
i Company, on the theory that-, the
j rates fixed by the franchise granted
j the company by the city of Wood-
burn were inadequate. The maximum
rate fixed Iy the franchise wis $1.50
a month and the commission almost
doubled it. Contending that the
franchise was a contract between the
company and the city, and that the
commission could not lawfully abro
gate it, the city after the decision of
the commission was made immedi
ately brought suit to vacate the or
der. The company was made a party
defendant with the commission, mid
an appeal will be taken to the su
preme court.
Jersey Cattle Club Meets.
Albany, Or., May 16.-fThe Linn
County Jersey Cuttle club held the
annual meeting yesterday at the
Commercial club rooms and Profes
sor Graves of 0. A. C. delivered an
address. F. B. Holt, Thomas Reed
and C. R. McCormack were elected di
rectors. The annual picnic will be
held June 14 at Conner's grove, near
Dever.
Old Resident Passes Away.
Monmouth, Or., May 16. James W.
McDowell, of Brush college, near
here, died recently. He was a resi
dent of Pennsylvania 42 years before
coming to Oregon, where he had been
living 30 years. Four sons survive
him. They are: Guy, William and
Ray of this county, and Harry, of
Salem.
