As used in this Ordinance the following words shall be held to apply and mean as follows: . .- (a) The term "street'' shall apply to .that part of a public highway or How to Prevent Croup. The cases average 100 each, and the total sales leads whole salers to say that never in their ex perience have they seen .such a move ment of oranges in one week. Now that National Orange day is over, merchants are turning again to the humdrum of spring trading. The term "horse" shall apply to any draft animal or beast of burden. v.- v .. (d) The term "vehicle" shall apply to a horse and to any conveyance except a street car. .. ' - (e) The term "motor vehicle" shall apply to all vehicles propelled by any power other than muscular. (f) . The term "emergency .vehicle" shall apply to ambulance, fire, po lice, public service, emergency and United States mail vehicles, while en gaged in emergency business. I .', (g) The term "driver shall apply to the rider, driver or leader of a horse, to a person who pushes, draws or propels a vehicle and to the operator of a motor vehicle. . - - (h) The term 'Sparked" shall apply to a waiting vehicle and to vehicles. (drawn up along side of one another not parallel to the curb. (l) The term "chauffeur;' snail mean any person operating a motor vehicle for hire or as the employee or the owner of a motor vehicle for hire. (j) The term "owner" shall include any person then in operation of the vehicle and be svnonomous for that person with chauffeur as to the operation of the same and shall also include any person, firm or association, rentintr a vehicle or having the exclusive use thereof under a lease or other- pwise, for a period greater than 30 days and these meanings of the term . "owner" shall 'be in addition to the usual signification of the word. ' Regulations For Vehicles Section 2. The following regulations for the use of vehicles upon the streets of the City of La Grande shall be observed by .the driver and person in charge thereof. (a) A vehicle meeting another shall pass to the right of the approach ing vehicle and each vehicle so meeting another shall, in passing, give to the other one-half the roadway. (b) A vehicle overtaking another shall pass to the left of such other vehicle and shall continue its speed and place to the left until clear of the over-taken vehicle and for such further distance as shall prevent dust and mud being thrown upon the over-taken vehicle. N . . (c) A driver of a vehicle, when approaching, an intersecting street, road or highway, shall have and keep under control his vehicle so as to permit a (vehicle approaching the inter-section from his right to first cross the intersecting street, road or high-way, . (d) .At all inter-sections of streets, roads or highways, a vehicle, ap proaching such inter-section, shall have the right of way over another vehicle approaching the same inter-section from the left, (e) A vehicle' shall not make a turn to reverse its direction at any place where traffic will be obstructed, but it shall go around the block or to a street, wide or free enough for the purpose. (f) A vehicle shall not follow another vehicle too closely for safety. (g) A vehicle shall not stop with its left side to the curb.- . (h) A vehicle shall not be left on a cross walk or within ten feet of a fire hyddrant or a United States mail box. " (i) A pff rked vehicle shall not occupy apace more than twelve feet from the curb between 9 a. m. and 6 p. m. (j) No vehicle or other thing shall be allowed to stand or remain in front of the entrance of any fire house. (k) A vehicle, on the approach of fire apparatus shall immediately draw near to and parallel with the curb and stop. (1) A driver slowing down, stopping, or turning, shall give timely and unmistakable signal by outstretched arm. Especially is this important when stopping quickly or turning to the left. The same signal may be used for all the above purposes. . (m) A .vehicle headlight shall be so controlled that it will not blind, dazzle or confuse other, users of the streets or make it difficult or unsafe for them to ride, drive or walk thereon. (n) Sound signals shall not be used except for necessary warning. ' (o) Sirens and automatic rotary gongs shall not be used except on vehicles of the Bureaus of Fire and Police. ( ' . Regulations For Drivers N - " ' Section 3. The following regulations shall be observed by the drivers and persons in charge of vehicles, while running or operating the same upon the streets and alleys of the City ofSLa Grande, Oregon. . (a) A vehicle, approaching an inter-section of streets, roads or high ways with the intention of turning there-at, shall when turning to the right, keep clearly to the right and, when turning to the left, shall run to and beyond the cente- of the inter-section 'at which such turn is made. (b) In parades, at theatres and on and at all other occasions and places where traffic is congested, vehicles shall foe operated with due care and caution and jockeying vehicles or the running of the same by each other, for position, is prohibited by this ordinance and each vehicle, upon embark ing and discharging its (load, shall at once move out of the way from the congested area and the next vehicle shall follow the same. (c) When traveling upon any street, road ctr highway, each vehicle shall 'be kept on the right half of such street, road or highway being traveled. . (d) No vehicle, while traveling uppn.any street, road or highway, with in the limits of the City of La Grande, Oregon, -shall be run at an unreason able rate of speed having due (regard to the safety of the public and the condition of the traffic and the use of the street, (Toad or highway then be ing traveled. ,. - ..,. 1 I (e) No vehicle shall be run or operated upon any street, road or high way in the City of La Grande, at iany time at a greater rate of speed than at the rate of 15 miles per hour, provided that this sub-division shall not apply to emergency vehicles, when operated as hereinaftel provided. (f ) No vehicle shall be moved, run or operated upon the streets, roads or high-ways in the. City of La Grande, Oregon, by any person unable to control or incapable of controlling the running or operation of such vehicle, with due regard to the safety of the public and othilr vehicles and that any person who is in a state or. condition of. . intoxication is, , under- the terms of this Ordinance, deemed incapable of so operating and unable to so operate or control a vehicle upon the streets, roads, or highways of the city. (g) No vehicle used upon the streets, roads or highways of the City of La Grande shall be left standing upon such street, road cr highway, un secured, and however it may be moved or propelled, its motive power, when such vehicle is left standing, shall be so secured that such power cannot operate or move the vehicle without some action on the part of the owner or operator for the purpose of moving the same. (h) No vehicle shall be operated upon any street, road, or highway of the City of La Grande with an excessive smoking exhaust. ' Emergency Regulation. ' Section 4. Emergency vehicles and the drivers thereof shall obey and conform to the following regulations. (a) Ambulances, while being operated as such, and vehicles used by or for doctors, physicians and surgeons, while being operated upon or in tJieir respective, business are exempt from the provisions of this ordinance as to speed and traffic regulations where the preference for right-of-way cari bo given them with due regard to the safety of the public and whereon account of an emergency, a faster rate of speed than that limited in this ordinance is absolutely necessary and, provided that when being so run or operated, each of such vehicles shall bear displayed thereon a red cross to indicate the busi ness in which the same is engaged. - (b) Patrol wagons, police ambulances, fire engines and fire apparatus shall in all cases, with due regard to the safety of the public, have right of way over other vehicles and fire vehicles the right of way over all others and all provisions of this Ordinance to the contrary notwithstanding, but the provisions of this section shall not be held to j-'rotect the driver of any such vehicle from the consequences of an arbitrary exercise of this right or for injuries willfully inflicted. Officers; Accidents Section 5. The drivers of all vehicles shall follow, obey and conform to the following regulations: (a) In all localities where an authorized officer, marslial, constable, flagman or policeman, conspicuously displaying his star, and then"discharging the duty of regulating and directing traffic in his locality, shall signal any vehicle to take a direction or to stop or otherwise ji(."0ceed 0r the safety of the public, it shall be the duty of such driver to obey such direction and comply with the orders of such officer in that respect. " (b) Should any pedestrian or other object, through want of care, or (other cause, come in contact with a moving vehicle n a street, road or highway in the City of La Grande, it shall be the duty of the driver of such vehicle to stop the same, and of such driver, owner or operator thereof to ascertain the name of the person or the object collided with and to render such aid Jand assistance as may be required af the time to any person in jured and, in case of collision or other accident, to render like assistance to the driver or occupants of the colliding vehicle or vehicle struck as the case may be and to take and keep the number, and description of the vehiale, the time and place of the accident, with other data concerning the same with the names of witnesses present and report the same with his name and residence jto the police department of the City as soon after the acci dent or occurrence as possible, provided, that such information shall not be construed or determined as fixing liability in either case for fault or neelierence of either Dartv but shall be used as a means of identification of the vehicles and parties concerned and the circumstances surrounding the accident or occurrence, and neither party to a coljision or a consequence resulting from miBtake in judgment or arising from accident shall move away from the place of the occurrence without first complying with this section, and the failure to'So comply with this section shall be a violation of the terms of this Ordinance and be punished accordingly. State License Plate Section 6. -No person shall operate or drive a motor vehicle on the streets, roads, or public high-ways in the . City of La Grande, unless Buch vehicle shall have displayed thereon the number plates assigned to it by the Secretary of State of the State of Oregon, conspicuously displayad on the rear and front of such vehicle in plain view and so as to be easily read by the public, and no person shall run or operate upon a road, street or highway in the City of La Grande any motor vehicle which displays more than one registration number upon such vehicle or any number which does not entitle the holder thereof to operate such vehicle upon the public high ways of he State of Oregon and, no person shall run or operate any such motor vehicle upon the streets of the City of La Grande which has not had assigned to it by the Secretary of State of Oregon a number plate or number provided, however, that the ownor or driver of vehicles owned by non-residenfca of the State of Oregon may be operated as in this Ordinance ' otherwise provided. , Lights, Signals and Brakes : Section 7. Every motor vehicle, while being run or operated upon any ' street, road or high-way within the City of La Grande, shall have thereon, and m proper working order, brakes sufficient to control such vehicle at all times and a suitably and adequate bell, horn or whistle or other sound signalling device and shall, during the period from one hour after sun-set to one hour before sun-rise, display upon such vehicle, while being run or operated, two white lights in lamps on the front of such vehicle and every such vehicle, while being so operated shall be equipped with one red light upon the rear of such vehicle and such rear lamp shall show a white light ""i!?88 k rear v vehicle- Sucn r01 laraP "haH be so constructed that . imimiiK or wumng, uie wnue iignt irom such lamp shall shine upon the number plate carried upon the rear of such vehicle. The light of the front lamps of any such vehicle shall be sufficiently strong to be visible at least 200 feet in the direction in which the vehicle is proceeding provided, however, that in any prosecution for a violation of this section, it may be shown, as a defense, that the rear light on any such vehicle was by accident prevented from shining or that the fact that the same was not shin ing, was not known to the operator of such vehicle; provided, however, that a persistent or continued operation of any such vehicle without its displaying such Tear light will be a violation of the provisions of this section and punish- ' ed as such. .. Motor bicycles or motor cycles and all vehicles other than motor cars shall be required to display but one lighted lamp on the front of such vehicle, the same to be so placed that it shall be visible for one hundred feet in front of and in the direction in which such vehicle is proceeding and each such motor bicycle or moto- cycle shall also show a red light upon its rear under the same conditions as are provided for motor cars. .' . ' ' j . -. ..Chauffeur-' ; Lr: Section 8. Every chauffeur registered, as in this ordinance provided, shall, while running or operating any motor vehicle upon any street, road or highway within the City of La Grande, display his badge as such chauffeur .,',.'.''.,..'.;'.: Chauffeur -Section 9. No person shall oiperate or drive as a chauffeur, a motor vehicle upon.any street, road or public highway within the City of La Grande unless such person shall have first complied in all respects with the require ments, of this ordinance relating . to chauffeurs and who shall not have registered as provided, by theOawa of the-State of Oregon and who shall not have received from the Secretary of State a badge permitting euch person, as a chauffeur, to operate motor vehicles, under the laws of ithe State of Oregon upon public highways thereof for the then year. - . , 'Chauffeur; :v '. .-' -v. fcoiiii sunn run or operate any motor vehicle as a . chauffeur upon anyjstreet, road or public high-way within the City of La Y Grande under any fictitious badge or under any badge issued by the Secre- v mmj wi uivgvii u any omer person. f Non-Resident Owners Section 11. All motor vehicles owned and operated by non-residents ot this State who shall have complied with the provisions of the laws of the -State of their residence relative to the operation of such vehicle upon the public highways therein are relieved for the neriod of thirtv dava fm th commencement to operate the same upon the streets or highways within vutjr vi uranue irom a compliance witn tne terms of this Ordinance relating to display on such vehicles, a number assigned to such vehicle by the Secretary of the State of Oregpn; provided, that all such vehvrles run nuig or operating upon the streets, roads or public highways within the City of La Grande, while bo running or operating, shall have conspicuously -displayed thereon the State number of such vehicle of the state from which the same came; but this exemption -shall not apply to motor vehicles of non- ' resident corporations doincr business within thin nta dents corporations from the. provision's of this Ordinance. i Competent Evidence , : V ,:-:-:' ' Section 12. In any trial before the Municipal Court of the city of La Grande for violation of the provisions of this Ordinance relating to chauffeurs and their registration, or receiving a badge, in or from the Secretary of State of the State of Oregon or any state concerning the registration of any motor vehicle or its receiving or having assigned to it a number out of ' ' or from the office of the Secretary of State of the State of Oregon or such' other State, a certificate issued by the Secretary of State of the State of Oregon or other state, stating the facts as to such registration or issuing of any such badge or number ishall be considered as proper evidence by such court.;; ; General 'Regulations. . Section' 13. Pedestrians, drivers of vehicles. and persons driving or in charge of horses, shall follow and conform to the following regulations: (a) During parades, the police may clear the streets and nrohihit vehicles and pedestrians from crossing the street, , (b) No pedestrian or vehicle shall break over or cross through the line of a funeral procession upon any street, road or highway. . ..: (c) A horse shall not be unbridled or left unattended in a street, road or highway without being securely fastened unless harnessed to a vehicle with its wheel so secured as to prevent its being dragged faster than a walk or unless such horse be hampered by a weightaufficient to control it. (d) A driver of a horse shall hold the reins in his hands at all times while riding, driving or leading a horse. ; --; - ' V (e) No one shall, upon any public street or highway, within the city, over-load, over-drive, ill-treat, or unnecessarily whip or permit or alio to be so treated any horse. ,(f) No one shall crack, or so use, a whip or other thing so as to excite any horse other than that which he is using or as to annoy, interfere with, or endanger any person. . (g) No one shall use a horse or permit a horse under his control to be used upon any street or high-way within the City of 1a Grande which usuch horse is not fit for its work or is not free from lameness or Bores likely to cause pain, or is not free from vice or disease likely to cause acci dent, injury or infection. Restriction As To Vehicles Section 14. The following restrictions shall be observed by the owners, operators and drivers of vehicles upon the streets and highways of the city, to-wit: (a) A vehicle, without a driver, shall foe left so secured that it can not be moved without human action and the machinery of a motor vehicle, (so left, shall be at a stand-still. . (b) A vehicle shall not be used which is so constructed, enclosed, equipped or loaded as to be dangerous, retard traffic or prevent the driver from having a view sufficient for safety. . (c) No one shall enter, ride upon, attach himself, or his vehicle to any vehicle without the driver's consent. (d) No one riding a bicycle or motorcycle shall hold on to another motorcycle or motor vehicle, while running. (e) 'No motor vehicle shall be operated , with -offensive exhaust . or with muffler open. ' ., , (f) No vehicle shall be driven along a side-walk. - 1 (g) Traction engines having lugs or spikes on their wheels shall not be driven on hard surface streets except upon planks affording sufficient protection to prevent injury to the pavement. .... (h) Vehicles shall not be allowed to carry or be driven or propelled upon the streets of the City, while carrying a load weighing more than five tons. (i) Vehicles shall not be so loaded as to spill their loads upon tho streets or highways. Responsibility Section IS. The driver or (person in charge of a vehicle,. when any offense, under this ordinance is committed shall be deemed the responsible person and liable to the penalties hereunder. - PENALTIES ' Section 16. Any person violating any provisions of this Ordinance, upon conviction thereof, before the Municipal Court of the City of La Grande, or who shall have pleaded guilty in such Court to any complaint for a violation of any provision of this ordinance shall be punished by a fine not to exceed . fifty dollars for each offense or by imprisonment in the city juil of the city . of La Grande, for not to exceed twenty-five days or by both such fine and imprisonment; provided, however, that any person convicted of or pleading guilty to or of a violation of any of the provisions of this ordinance who ""ill be sentenced to pay a fine, shall also be sentenced in default of the payment of such fine, to 'imprisonment in the City jail for not to exceed one day for each two dollars of such fine and, provided also that any person convicted of, or pleading guilty to a violation of any of the provisions of this Ordinance, and by the rfcords of the Municipal Court, such person shall be shown to have been convicted of or plead guilty to the same offense within one year, he shall bo punished by a fine not to exceed one hundred and fifty dollars or by imprisonment in the City jail for not to exceed seventy-five days or by both such fine and imprisonment. .Repeal Section 17. All ordinances amrparts of ordinances in conflict herewith and ordinance number 601 Series number 1912 are hereby repealed. Section 18. This ordinance shall be in force and take effect from and after its passage and approval by the President of the City of La Grande. Passed and adopted by the Commission of the City of La Grande, Oregon, on this 1st day of December, A. D.J915, by 3 Commissioners voting therefor.
