Mrs. Ora English received the sad news Wednesday morntap; of the death of her brother, Ben Simmons, in Cove that morning says the Wallowa Sun. The cause of his death was not learn ed. Mr. Shmmons was about 84 yeir8 of age and at one time was a resident of Wallowa, having scent his bovhood days here. He is survived by his wife and ne son; Ihis mother of Cove; two brothers, E. W. of Ui.ion and Grover of Cove; three sisters Mrs. Nelson Dexter of Crook county, Mrs. J. M. Stephenson of Pendleton, and Mrs, English of Wallowa. ,. 'Mr. and Mrs. English and her mother, who has been visiting here, left on the train Wednesday to at tend the funeral. (Special) , Haines Is up in arms over a case of cruelty to a dumb animal that came, to light last evening., , . It was reported" to Marshal Heninger early this .morning that a horse had been abandoned by its driver and left to die . in tne snow, aooux lour nuies f'om here. Accompanied by Dr. Bis well, Mr. Heninger went to the scene, where the animal was found almost buried in the snow and almost dead. The marshal shot the horse and pro ceeded to make -. an investigation, which, resulted in . discovering the identity of the man who abandoned the horse, when the animal was taken sick, in .the storm and unable to proceed.- The marshal has his evidence well in- shape and an arrest and prose cution will follow, within the next few days. " There have been several recent cas es of cruelty to animals in Haines and vicinity, and it is proposed to make an example of one or two as a warning to btihers. The case cited is one of the worst that has ever been brought to the notice of the peojple No Affidavits .Required. Salem, Or., Jan. 7. Attorney Gen eral Brown has rendered an opinion to the effect that under the prohibition law it is not necessary for a- retail druggist to furnish a wholesale drug gist with an affidavit before the latter is authorized to sell to the retailer ethyl alcohol "Our law makes no such provision nor is. there any suggestion contained anywhere within the act that it is necessary for the retail druggist to file an affidavit with the wholesale druggist." he said. "Such retail dm. gist, however, is required to file an affidavit with the common carrier be fore such common carrier is author ized to deliver alcohol to' the con signee, whether such consignee is a druggist or otherwise." . r. ) Near-Beer Is .
