The East Ore gonian said last night: Mrs.Charles Oglivie, living; in Cal ifornia Gulch, seven miles south of Pilot Rock, was murdered last even ing by Lee Dale, a homesteader living near by and when Mr. Oglivie, aged husband of the mudered woman rush' ed to her aid Dale placed the muzzle of the gun against the old man's stom ach and fired. Mr. Oglivie will pro bably die. . At the time of the murder Dale was on an "alcohol" drunk and when arrested thia afternoon by Sheriff Taylor was still in a drunken condi tion. He was arrested by the sheriff who found him lying in bed with, a loaded 33-30 rifle by his side. The sheriff grabbed the rifle and then placed Dale under arrest. The full circumstances of the mur der and probably double murder made a very brutal tale of horror. . Dale arrived horseback at the Ogilvie place about 7 o'clock last evening according to Mr. Oglivie who was rational this morning and made a complete state ment. When Dale arrived Mrs. Ogli vie was sitting on the porch and Mr. Oglivie was in the milk house 20 feet away,' Dale began quarreling with Mrs. Oglivie and cursed her. . Ac cording to the old man's story the two "jowered" and Mrs. Ogilvie told Dale to go home to his wife. : He then drew his revolver and shot her, the bullet striking just ' below the left arm and evidently striking the heart. ' Rushing out to assist his wife, Mr. Oglivie caught her just as she fell After being himself shot, Mrr Oglivie made his way into the house and fell unconscious on the floor. Later, he became conscious and thinking he would die wrote a statement of the crime on a calendar. This morn ing he corroborated his written state ment in' talking with a dozen or more people gathered from Pilot Rock. He then became unconscious and - was taken to Pilot Rock where he is be ing operated upon this afternoon. Slept Near Corpse - ., Discovery of the ghastly crime was made this morning by James Stubble field, a young hired man on the Ogil vie place. Last evening Stubblefield went to his home place to spend the evening and did not return . to the Ogilvie place until midnight when he went to sleep in a tent, wholly ignor ant of the murder and of the fact his employer was. then lying at death's door inside the house. Arising this morning Stubblefield wondered why the old folks were not in evidence. Going to the house he was horrified to see the body of Mrs. Ogilvie on the porch. Without stopping to learn anything more he hastened to the-Knotts ' place at the mouth of California Gulch and gave the alarm.- . -vr -'. At the time of the murder- Miss Elsie Ogilvie, daughter of the couple, was living in her : homestead eahin and enroute to the Knotts place Stubblefield toid her of the affair. V .'.,... ... Mrs, Dale said her husband arrived home last evening and , had left his horse, saddled. She unsaddled the horse and fed the animal and her husband went to bed. He said noth ing what ever of the crime and Mrs. Dale was ignorant of it until inform ed of the facts today. She said her husband awoke several times during the night and asked for a drink but I said nothing else. He has been in the habit of coming home drunk and is said to have abused his wife. Those who know Dale say he is a good citizen when sober and is the last man they would suspect of such a murder. Mrs. Dale is a very fine woman and much sympathy is ex pressed for her. She remained at their home. The Dales have no children. They have lived oa their homestead for four or' five years.'
