A suit against the county was filed by the. Woolgrowers' Warehouse company on Tuesday, perhaps too late for trial at this term of the Circuit court Damages of $1223 are asked because of the destruction alleged to have been wrought by the overflow, waters from a branch of the river in June, 1913. . In May, 1912, the complaint asserts, the county reconstructed the wagon road leading due south from town, and placed as bridges for the branch of the river, galvanised iron pipes imbedded in concrete. ' It is alleged that these pipes or tubes were of in sufficient size to carry off the surplus water at the time of the mild freshet in 1913, and the overflow went north along the highway to the O.-W. rail road tracks, thence west, to the ware house, and into its basement.' Tim othy seed was Boaked and spoiled, canned goods rusted, lumber was dam aged, books were ruined and other articles were wet, it is alleged, caus inga loss of $1150. The expense of removing the goods from tne base ment was placed at $83, which added to the other claim, makes the total of $1223 asked. . The warehouse company is repre sented by Daniel Boyd and W. S. Burleigh. The action is brought un der a new decision of the Oregon Su preme court, which ruled that county can be sued for damages. The suit of C. K. Pones and J. E. Maher against C. Murdock, the Day Ridge rancher, which has been hang ing Are in Portland since last sum-, mer, has been transferred to the Cir cuit court of this county. This is an net inn hv-which Mr.-Fones soueht to force performance of a contract made last Spring with Mr. Murdock. Mr. Murdock, having won the suit over the personal property, has been putting up a stitr legal ngnt to nmu the land, about 2150 acres of much value. The prosecution met with re verses in the court in Portland and so filed a new suit here.
