Frank, thrice convicted1 of murdter- ing Mary Phagan, young factory girl in April, 1913, was in his cell hope fully, awaiting the result of his ap peal to the United States Supreme Court allowed by Justice Lamar. This iwas the day last set for Frank's exe cution. It was the third time he had been sentenced to death. The writ -ted by Justice Lamar automat ically stayed execution of the death penalty today until Frank's appeal is determined!
