The biggest con test for water rights ever instituted in Baker county was settled put of court by stipulation late yesterday aft ernoon, thereby disposing of a contest involving the water rights of 12,000 on Killimacue creek, Muddy creek and Rock creek in which more than 200 lit igants were engaged. The lands are all in the Powder Valley west of Haines. The farmers showed they had been using the wa ters of Rock Creek since 1868. The contestees which are the Rock Creek & North Powder Irrigation company, Davis Wilcox and others claimed prior rights by virtue of the purchase in 1900 of the Waggy ditch which had been built from Killimacue creek to Muddy creek in 1865. - The farmers showed that the Waggy ditch had been abandoned for 30 years, after it had been used for mining purpos es and on this showing won their contention. The contestees claimed , the right to 1000 inches of water in Rock creek by virtue of this pur j chase, holding the right to take the waters from Rock creek through the Wilcox ditch, below the junction of Rock creek and Killimacue creek. In the stipulation the contestees. abandon all claim and right to the priority date as represented by the Waggy ditch and agree that priority claim to any water which the Killi macue Lake reservoir and Rock Creek Irrigation company may store shall be the rule and the contestants agree to dismiss all further grounds for suit. The farmers were represented in the action by Attorney Frank B. Mitchell and the contestees by Attor neys O. B. Mount and Joseph J.
