COMMERCE COURT IS DOOMED.
The doom of the commerce court
is written in the concurrence of the
senate appropriations committee to
that section of the urgent deficiency
bill, pasted by the house abolishing
it. This action, coming aa it does
from a powerful committee, probably
will be . upheld by the upper house.
A glance at the history of former
legislative action toward this court
certainly gives no ground for optim
ism as to ultimate action. Created
in 1909 at the suggestion of President
Taft, it had a hard time surviving
the various assaults made on it This
tribunal, it will be recalled, was given
the jurisdiction formerly held by the
United States circuit judges over all
the boarding house inmates will hold

law. It was promptly rebuked by the
supreme court. . '
The basic fault with the court was
that it attempted so often to substi
tute its opinion for the expert judg
ment of the interstate commerce com
mission. This paved the way for
its undoing.
