(To the Editor) There has been a great deal of discussion among the anglers of Union county, as to whether or not a person entering, the premises of an other to fish, without permission, is a trespasser. ' It is contended by many, that any persons desiring to fish on the prem iMS of another, without permission, is not a trespasser as long as he re gains in the creek, or passes over the premises by wading down the creek between the high-water lines. Up to the present time, however, I have been unable to find any author' ity of law for such a contention; but, on the contrary, it seems that the laws passed by the last legislature suggest a somewhat opposite view. ' Section'' 1985, Lord's Oregon laws, provides: ' "If any person other than an offi cer on lawful business shall go or trespass upon any inclosed lands or premises not his own, and shall fail, neglect or refuse to depart therefrom immediately and remain away until permitted to return upon verbal or printed or written notice of the owner or person in the owner or person in the lawful 'occupation of said lands or premises, such trespasser shall be deemed guilty of a misdemeanor, and upon conviction thereof, shall be pun ished by fine of not less than $5.00 or more than $50.00, and Bhall be com mitted, in default of payment of the fine and costs imposed to the jail of the county in which the offense 1-as committed." , Section 1986, Lord's Oregon laws, as emended by chapter 185, laws 1913, at page 349 thereof, provides: "Printed or written notices having attached thereto by authority, the; name of the owner or person in the lawful occupation of said lands or premises and requiring all persons to forbear trespassing on said lands or premises and to depart therefrom, posted in three conspicuous places on said lands or premises shall be held and deemed to be sufficient prima facie evidence of notice as mentioned in section 1985." Section 41, chapter 232, laws 1913, at page 441 thereof, provides: "Navigable r rivers, sloughs . or streams within the meander lines, or if not meandered, between the lines of ordinary high water thereof, of the state of Oregon, and all rivers, sloughs and streams flowing through any public lands of the state shall hereaf ter be public highways for the purpose of angling thereon and any rights" or title to such streams, or the lands between the high water flow lines or within the meander lines of navigable streams - hereafter acquired by any person shall be subject to the right of any person owning an angler's license of this state, who desires to angle therein or along their banks, to go up on the Bame for such purpose, provid ed, that the provisions of this act shall not interfere with valid existing rights." From my examination ox the low, I am unable to find anything in ad dition to the foregoing provisions, which will permit any angler or fish erman to enter the inclosed premises of another and fish thereon without permission, provided, notices have been posted as required by section 1986, as amended. The law is plain in this connection relative to uersons who ''enter inclos ed premises for the purpose of hunt ing; but there seems to be no provis ions permitting a person to enter inclosed premises for the purpose of fishing. 1 There are few anglers who desire to entev the premises of another unless they have a legal right to do so, and none of us have atvy desire to be sub ject to arrest when we innocently eg ter inclosed premises of another without permission. If there is any law which author izes us to enter inclosed premises and fish thereon between the high water lines, I would appreciate very much to be advised, and I think there are many others who would receive it with an equal appreciation. , - " If we are a bunch of sports and artiste in casting the rod, let's be sports and artists, but while .we're doing it, let us be law abiding citi zens and know our rights.
