Bumgarner, recently arrested in connection with the at tempted poisoning of his entire fam ily at South Baker several weeks ago, will be held next Friday before Justice of the Peace F. L. Hubbard. The hear ing was to have been held last week but was postponed to allow the pris oner time to employ counsel. Bumgarner at the time of the post ponement protested against his hear ing being held before Judge Hubbard on the grounds that before appoint ment as justice he had been counsel for Mrs. Bumgarner in her success ful suit for divorce against her hus- , band. There is no portion of the stat ute covering a change of venue in justice court, only a change in the trial courts being provided for. .'The justice court does not pass sentence and there is no authority higher than the justice to ordei such a change as desired by BumgarneT, even were it pernlTSsaltle under f lie statute.
