Works Warrant.
Joseph, Ore., Aug. 12. (Special)
The suit of F. D. McCully, owner of
the old water works system, against
the city of Joseph, to restrain the pay
ment of a warrant Issued to J. M. Mit
chell, the contractor of the new water
works system, for extras under bis
contract, has been dismissed by Judge
Knowles. The contract called for ex
tra work, and the charter contained a
provision against any expenditure over
$1,000.00, except on a vote of the tax
payers. Claiming that this provision
and another against the Issuance of
bonds In excess of $20,000, and war
rants of $5,000.00 at the same time,
had been violated, McCully brought his
suit. The litigation has been pending
for a great length of time but immedi
ately upon the filing of the decree and
the setting aside of the Injunction, the
Joseph council, at the request of the
holder of the warrant, made necessary
transfers of the funds of the city and
being on hands sufficient funds,
the warrant was promptly paid, there
