(Special) The litigation' over the Forsatrom bank rapt stock ot general merchandise here bajs taken still another turn. A. W. Sshaupp, who was appointed by the federal bankruptcy tribuanls as trustee ol the estate of tbe bankrupt, baa dismissed the recent suit filed by him for possesion of the stock in the Wallowa county circuit court, at the Instance of Portland creditors, and has filed a similar suit in the Federal court at Portland. A U. S. marshal has taken possession of the stock from Ole Miller, who regained in the circuit court of Wallowa county in May the possession be bad taken un. der a chattel mortgage, prior to tbe attachment suit which last fall closed the store, and In connection with which the sheriff at the time took the store from Miller. It was thought by the Portland people that a final de cision could be obtained sooner by taking the matter into the Federal spurts. T Miller will continue the fight for his possession. If be loses he will then share with the other creditors in proportion to the amounts held by each against Forsstrom. Recent complications In connection with this case are told in the Enter prise Record-Chieftain. Licensed saloons will ope nin Jo seph In a short time, according to present Indications, says the Enter prise Record-Chieftain. Five appli cations for licenses have been re. celved by Recorder August hlte. These will come before the council at Its neM meeting and will be referred to the license committee. The city ordinances provide that two' weeks time must be given after this to per mit of remonstrances to the applica tions, i No meeting of the council was neia nday night, but a special session can be called at any time by Mayor McCully at the request of council men. Some members of the council are now out of town and the special meeting probably will be postponed until they return. Applications for licenses have been made by Xavler MIchellod, E. T. Schluer, Jack Quick and Hayes Ker nan of Joseph and G. B. Campbell of La Grande. A vote on license was taken In Joseph last November. When It be came apparent from the unofficial count, that saloons had carried, pro . bibltlonlsts took active steps to pre-, vent the issuing of licenses. At tbe time no construction of tbe law had been delivered to permit saloons any where in a prohibition county, and Wallowa county was "dry". Anti saloon advocates therefore took prompt steps to prevent the nullifi cation of county prohibition. They obtained an Injunction re- straining the county court from can- vassing and certifying tne election. This case has been on t'.ie docket of Judge Knowles of the Circuit court for some time. Th' ened In Springfield, although It was in a prohibition county. Tbe Josepb injunction was dissolv ed by Judge Knowles at La Grande, June 3. Carl Roe and A. F. Sheet canvassed the votes as justices ot tbe peace and found 02 ballots against saloons and 97 for them. This can vass was made on Friday at the court bouse and the result was ex actly tbe same a unofficially an nounced Immediately after the elec tion. On Saturday the county court met and certified tbe count. Tbe result will be officially brought before the Joseph city council at Its next meeting. As to the application of the Joseph case at a precedent in other cities, ot the county, these - facts must be borne In mind: Tbe first step for the opening of a saloon Is a vote of tbe people of the town on tbe question of issuing licenses. If tbe vote is against licenses tbe matter ends there. If it Is In favor of license, it is only per. missive in nature. The scared boy gave a yell like a Comanche Indian and kick ing and struggling to get tbe thing loose lost his balance and toppled over Into the river. Boy, eel, fishing pole and everything. L Avenue, running from Washington Avenue at the head of Connordale, past the city hall to the high school, is to be opened up. Electric lights and telephones have already been in stalled in the new houses built on Connordlae and a street lighting system will soon be provided.
