' s . The crime for which Shaw is now being tried, was committed February 27. On that date, Shaw, who lived in La Grande, Oregon, called at the home of Attorney ; John It, Sharp stein, 431 Lincoln street, where his wife was employed, and after a short quarrel, It is alleged, killed her with a revolver. e tnen gave himself uo to the authorities. The regular venire of 32 Jurors was exhausted before the 12 men neces sary to try the case was secured special venire of 12 men was then drawn and following this another spe cial venire of 18 men. By this time the state had used five of its six per emptorles while the defense had used 11 of the 12 peremptories allowed them. At this stage by consent of both sides Sheriff Mike Toner was ' thn empowered to draw an open venire of four men and from this list the 12th and last Juror was drawn. f, , Of all the persons excused, a num. ber rendered themselves Ineligible ' owing to the fact they they are op- posed to capital pun Ishment.
