After num erous postponements the, now famous Kimmel case, one of the most . puzzling cases of recent time, luvolving a ques tion, of jdouble Identity, was'called for its third trial before the United States district court in this city today. The suit is by the receiver for the Arkan sas City, Kas Farmers' State bank, of which George A. Kimmel was cash lerwhen he disappeared in July, 1898 against" a prominent life Insurance company of New York, in which Kim mel was Insured for $25,000. - At the first . tfyal a verdict for $8,000 in favor of the plaintiff was given, but the ver dict was reversed .later on by the court of appeals and the case remand ed for retrial. In July, 1898,, while being cashier of that bank, Klmpiel disap peared leaving a considerable short age. Klm meL;wlth whom tie had a remarkable resemblance. The man had been liv ing in the state of New York under the name of Andrew. J. White and he seemed to have quite a criminal rec ord,, which began in 1904, when he was . committed ; to. the ; Erie county prison. , He served several sentences, the last, for larceny, at the Auburn penitentiary. 'For some reason White was sent from Auburn to the Maltea wan, hospital for the criminal Insane, but , -he obtained his release upon a habeas corpus. Upon his release White was taken to Nlles, Mich,, where, however; the relatives of Kimmel refused to admit tho identity of While with the missing faiinmel. v Some of the' relatives-, of lvlmmel, however, changed their mtntl nflcr they had talked with White and became so convinced that he was real ly Kimmel, that they received him at their homes. The residents of Nlles muny of whom had personally known Kimmel, were also : divided in their views. While some believed that the claimant was identical with Kimmel, others were inclined to doubt this and considered White a-pretender. . ; Tho proofs for White's identity with Kimmel which the Insurance comnany submitted at the first, and .' second trials were not considered sufficiently strong to establish the claims of tho defendant company. . Since then, how ever, additional evidence Is snid to have been procured. At the former trials ,the most important witness of the plaintiff was John Moore Swlnney, a New .Mexico ranchman, who testified that he saw Kimmel killed In an Ore gon wilderness In August, 1898. ., . Since thd last trial the plaintiff's lawyers have made every effort to ob tnblish the complete record of the man known as Andrew J. White and it is said that his whole life history for the lust thirty years has been Investigated by agents of the plaintiff. Practically all the voluminous evidence, Includ ing the prison records, photographs, and other documents which establish the' prison record of Andrew J. The mother and. the sister ,sof Kimmel will . be among the principal 'Witnesses for the complainant and will positively deny the identity of White with Kimmel, as they . had done In the former trials.'
