A news dispatch from Salem to a
Portland paper deals more fully with
the victories of L. Rewillard and oth
ers before the supreme court relative
to the appeal of their convictions for '
selling liquor when Union county -was
dry. Explaining the reversal the court

Two Union county local option cases
were reversed in opinions by Justice
Moore today, these being the cases of
Victor Townsend and Dell Kennedy
and L. Remillard. In the Townsend
case the court in construing the loril
option law,-says that It was pattern-j
ed after the Texas law, and. that it Is
a well known rule of construction in
Oregon that when a law of this state
Is borrowed from the law of another
state that Us construction here will be
similar to that applied by the court of
the last resort In the state from which
It was borrowed. i
The appeal was grounded on fallurj
to sustain a demurrer that the aver
ment did not give facta sufficient 'to
constitute a crime. "The failure to
aver that an election had been held in
Union county at which a majority of
all the votes cast on that subject fav
ored prohibition rendered the ln.llet
ment inadequate In that it did not slate
facts sufficient to constitute a crime,
and an error was committed in over
ruling the demurrer interposed on that
