ON" Texas Law Borrowed by Oregon and Texas Precedent a Guide' The Grocery . Phone 70. Stageberg & Sandborg Plumbing and Heating JbhnMelville l8 Mams An IA GRANDE, ORE- A news dispatch from Salem to a Portland paper deals more fully with the victories of L. Rewillard and oth ers before the supreme court relative to the appeal of their convictions for ' selling liquor when Union county -was dry. Explaining the reversal the court eays; " v. j Two Union county local option cases were reversed in opinions by Justice Moore today, these being the cases of Victor Townsend and Dell Kennedy and L. Remillard. In the Townsend case the court in construing the loril option law,-says that It was pattern-j ed after the Texas law, and. that it Is a well known rule of construction in Oregon that when a law of this state Is borrowed from the law of another state that Us construction here will be similar to that applied by the court of the last resort In the state from which It was borrowed. i The appeal was grounded on fallurj to sustain a demurrer that the aver ment did not give facta sufficient 'to constitute a crime. "The failure to aver that an election had been held in Union county at which a majority of all the votes cast on that subject fav ored prohibition rendered the ln.llet ment inadequate In that it did not slate facts sufficient to constitute a crime, and an error was committed in over ruling the demurrer interposed on that ground," says the court. The esJiie ruling. was given In the Kennedy and! Kemlllard case. . r Among other cases decided, all re versals, were as follows: ' George Palmer Lumber company ap pellant, vs. Wallowa County, respond ent; appealed from Wallowa county, J. V. Knowles, judge; reversed In an opinion by Chief Justice Eakin. This was a proceeding to review the aotlo 1 of the county court of Wallowa county In laying out and establishing a road. union of the Farmers Educational and Co-operative union will be held in Pendleton. It will be open to all members of the union though the state union is a dele, gated organization composed of rep resentatives from the local and coun ty organizations. As arranged by those in charge of the election of state officers. C. S. Barrett, of Georgia, national president of the farmers' union, Is to be a guest at the meeting in Pendle ton and his presence will add much in terest to the gathering In riew of his position.
