Game M'arden Finds Stwam Befouled
by Edgings and Other Matter.

Complaint having been made that
Claude Huffman, manager of the Ad
ams & Pilgram mill, about nine miles
from Elgin, on Indian cneek, was
throwing edgings into the creek and
burning them there, the city council
ordered Marshal Christiansen to visit
the place and make a thorough inves
tigation of the matter, In the Interest
of Elgin's water supply. Mr. Chris -tianson
went out Tuesday afternon,
accompanied by two state game war
dens, and found a very bad state ol
affairs existing. ' A forest reserve
man h.ad visited Huffman a short time
previous and had Instructed him to
quit the practice. On their return the
game warden notified District Attor
ney Ivanhoe at La Grande, and he
immediately notified Deputy Simmons
to draw - the necessary papers for
Huffman's arrest. Justice Barnes ap
pointed J. C. Christiansen deputy con
stable and Huffman was arrested on
Wednesday afternoon and brought be
fore the justice in the evening.
Mr. Simmons, of the district attor
ney's ofllce, appeared for the state, and
Messrs. Denham and Dixon for the
defense. The defense moved to quash
on the ground that the complaint was
not in proper form, In that It was
sworn to in the words "verily believe"
that the offlense charged had been
committed and, according to the de
cision, based on the constitution of the
United States, this did not give the
court Jurisdiction. The district ati
torney asked leave to amend the
complaint, but this was denied and
Huffman discharged. "
The ' district attorney immediately
proceeded to draw a new information
and i warrant was placed in the con
stable's hands for Huffman's re-ar
rest, but on looking for him It was
found he had left town.

La Grande Land Office Hands Down
Decision Upholding Entryman.

Henry W. Downs' homestead entry
on the South Fork, six miles south
of Lostlne, has been upheld by the
La Grande land office, and the contest
Instituted by the government held for
dismissal. ; - . , , , , .
Mr.; Downs filed on the land July
28, 1903, and on April 26, 1909, sub
mitted final five year proof, but the
certificate was withheld upon protest
of the field division chief. Contest
proceedings were ordered Jan. 25,

Irrelevant matter about residence and
cultivation, which were not issues In
the case, was finished, it is disclosed
by the record that one whole day had
been consumed by an expert short
hand reporter."

more valuable for mining than agri
