T. G. Wilson Involving the water rieht
on Alex Stackland place, was resumed
this morning and occupied the greater
portion of the day. The hearing is be
ing conducted in the Commercial Clno
rooms before Hon. F. M. Saxton. Sup
erintendent of Water Division No. ?..
An interesting feature of the case
is that It is the first of the heirings
in Union county resulting frora the
new water law passed by the last leg
islature. It is the beginning of a con
test over the waters of Mill creek near
Cove, the claims in which were filed
at Cove late in September.
According to the complaint In the
case the Caldwell Ditch company ap
proprlated the waters from Mill Creek
In 1866 and completed the ditch in
1867. It is disputed that the Stackland
place was ever entitled to water from
the ditch. Some of the witneses tgtl-
j fled that at one time the holders of
j water rights along the stream gave
Stackland permission to use water in
j order to avod trouble. .
In regard' to the adjudication of the
rights along the other streams In'
Union county, Commissioner Saxton
said today that the npplipations for
hearings from Catherine and Murphy
Creeks came In late nnd they wuiild
have to be left over for some ime as
hearings in other portions of Eastern
Oregon would come in ahead of Miem.
