It is the beginning of a con test over the waters of Mill creek near Cove, the claims in which were filed at Cove late in September. According to the complaint In the case the Caldwell Ditch company ap proprlated the waters from Mill Creek In 1866 and completed the ditch in 1867. It is disputed that the Stackland place was ever entitled to water from the ditch. Some of the witneses tgtl- j fled that at one time the holders of j water rights along the stream gave Stackland permission to use water in j order to avod trouble. .
