held last evening when the case of the
j Phoenix Insurance Company and Jen
I nle Halverson vs. the O .R. & N., com
I pany was taken up. This case occupied
practically the entire day today.
! The Insurance company is suing the
railroad for the recovery of the 1100
paid to Mrs. Halverson when her barn
burned at Hllgard on January 29, 1909.
Mrs. Halverson Is a party to the suit
although she is asking no damages.
The railroad paid her 100 and the
Insurance company $100.
, An interesting feature of the trial
tcday was the way in which a witness
by the name of Allen came up for the
railroad with Atten ry frcTn
the one told to the attorneys for the
company a few days ago. He told the
attorneys when they visited Hllgard
that the wind at the time of the fire
was blowing toward the railroad from
the barn, but on the stand he said the
opposite was the case and a lively tilt
between Charles Cochran for the rail
road and Attorney Sargent for the
insurance company followed In which
the court ruled that an attorney had
the right to impeach testimony of the
witness in his own case If he wished

BOY GIVEN TO GRANDMOTHER
SCHILLING LAD TAKEN FROM HIS
FATHER TODAY.
Alleged Abuse Responsible for Scpa

The nine-year-old Schilling boy
whose case has been before the court
for several days was today awarded
to his grandmother, Mrs. George Eurns
of West La Grande, by the order of
Circuit Judge Knowles, this' morning.
John Schilling, father of the boy.
was arrested Saturday by Constable
Faulk for abusing the youngster. Thn
story goes that the lad was forced to
hurry home from school which he at
tended in Bcanty clothing and was com
pelled to do several hours of hard
work after his return. His step moth
er was also implicated as participant
in the alleged abuse.
Schilling was arraigned yesterday
but today the case was disposed of by
the grandmother of the boy being as
signed the custody of the lad. In the
case that the paternal home agrees to
treat the boy. with due kindness the
court will again return the lad to his
father.
REV SEEMANN IS DELEGATED
For the first time In the history of
the work of the Presbyterian church
In Oregon the chairmanship of the
home mission committee of synod was
placed In the hands of a non-resident
of Portland, at the meeting of synod
last week. This honor fell to the lot of
Dr. S. W. Seemann of this city.
; In addition to this honor Dr. See
mann was also elected to represent
the church of Oregon at a national
council to be held In New York City,
November 14. This council is . to be
composed of representatives of each
synod, . two representatives . "of the
National Home Missionary Board,, the
National Foreign Board and of. tha
National Sunday School Boards 'At
this meeting It Is hoped to ge.t a gen
eral view of the progress of . the
church in America and to lay plaus
for the future. . - . -. . . .
