Construction of a permanent tele phone line from this city to the intake of the Beaver Creek water project pipe line, 18 miles away, and the construc tion of a caretaker's cabin to be oc cupied by the man who is to stay at the intake day and night to attend to the proper running of the supply of water, will go hand In hand with the digging of the trenches and the paying of the steel pipe, according to Engineer Dutch and Engineer Pick ler, who are here today resting after three days strenuous climbing and ar dorous exploration of the proposed pipe line. MEANS A MONTH IN COUNTY JAIL Will Appear as Witness in Two Trials "Against Atkinson. Albert Keller the witness in the cases in the city court charging Ralph Atkinson with selling liquor, was to day placed in the county Jail to await the sitting of the grand Jury where he will appear as a witness in the state caces against Atkinson, j pre ferred last night. Last evening At kinson was arrested on three charges on warrants sworn out In the Justice court, each one 'charging him with selling liquor in violation of the local option law. They are separate to those in the city court. Keller is held as a witness on two charges against Atkinson, the bonds being $300 on each count. Being un able to meet the bond, he was placed in Jail to spend a month there at least that he may appear as a witness. One witness which the state had corralled, was shipped out of the city, it Is said by the saloon element and to avoid a duplication of the trick, Keller is In Jail. The first witness called in the first case was Chief of Police Rayburn and ha testined that he asked the man Keller the man who is claimed purchased the whiskey from Atkinson, if he, Kellef, could get any whisky in town and that Keller stated that he could and Ray burn asked him to purchase it for him. Rayburn says that a short thne later Keller came to him with the whiskey. Keller was called and he corroborated Rayburn in saying that Ra,yburn had asked him to purchase some liquor for him and that he pur chased the liquor from Atkinson. When Atkinson was called he denied ever having sold any whiskey to Kel ler, and stated that Keller came into his place of business and demanded that he sell him some whiskey. When he refused, he said that Keller grew belllgerant and tried to force him to sell him whiskey. ' ' . The case was taken under advise ment and the second case was called. After Recorder Cox had overruled the demurrer that was filed by Judge Ramsey, the council for the defend ant, Atkinson pleaded "not guilty." The first witness in the case was Chief Rayburn and he stated that when he received the first bottle of whiskey, which was tne bottle ex hibited in the first case, he asked Kel ler if he could get apothcr and Keller stated that he could and the Chief then gave him the money and told him to go and get it. Before Keller started to get the whiskey Rayburn stated that he made sure that he had no other bottle with him and that he then fol lowed Keller and saw him enter the Palace Saloon and remaining there for a few moments he came out and went around to the Recorder's office where he delivered the whiskey to Reyburn. When Keller was called h9 corroborat ed Reyburn in his testimony and also stated that he secured the whiskey from Atkinson. Atkinson was called and as before he denied selling the whiskey to Kel ler and stated that he never worked In the saloon at all on Sunday morn ing and that the only time that he was behind the bar was when he went to put Borne change in the till. William Kooser was called and ho testified that he was tending bar there on Sunday morning and stated that Atkinson was in and out of the place all the morning and also stated that he never saw Atkinson sell any whis key to Keller or any one else for that matter. . Both bottles of whiskey were held as exhibits in the case. A decision will be rendered tomorrow in both of the cases. ' lay In Election. , On account of the light member ship present last night the election of the president and four directors was postponed. Sam Berger, representing Jeffries in the prepara tions for the Jeffries-Johnson fight is to leave tonight for California where he will make all final arrangements for the the world's championship bat tle. He said that he had received the offer of $G2;000 from Tom McCarry, the Los Angeles promoter, but was waiting to see Promoter Jim Coffratb j of San Francisco, before clinching the rrangements. It is apparent from Ber ger's manner that he believes the fight will be pulled off in the state of Cal ifornia. , ' . - . Nothing to Bid on. - News of the coming of Berger las aroused little interest here. "What Is there to bid on?" when asked if he prepared to make a substantial bid when Berger arrived. Coffroth said "There isn't a match on between the big fellows, as I see it" Many fans take a similar view. Posse After Robbers. TULSA, Okla., Aug. 17. A posse Is pursuing the two robbers, who after attempting to rob' the Klefer bank, shot the Cashier WeMing, and killed Town Marshal Inford in a street battle late yesterday evening.
