The attention of the court was taken

In his opening address to the jury
Attorney Hodgln stated that the state
expected to prove that the defendant,
together with Frank Parker and Boy
Hawley, procured a tenm from a liv
ery ijtiibli; in th!" city and on th?.t eve
ning the tracks found In the vicinity
of the Oliver home and leading to the
home of one of the parties named In
the Indictment, corresponded with the
shoes on the horses furnished them,
and that the boys upon returning the
team to the stable requested that the
stable attendant say nothing about
them having been out with a team.
The buggy also showed evidence of
having come in contact wilh grease.
Defense Take Alibi .Method.
Charles Cuchrun for the defense, in
his remarks to the Jury, stated that the
defense expected to prove that the de
fendant, Rube Chandler, could not
have been connected with the theft,
as he would be able to produce wit
nesses who would testify to having
seen and conversed with Hie defend
ant at the time when the indictment
claims the robbery took place. At 1:30

gan and it is not unlikely that the

At 3:30 this afternoon the state
had placed two itne-se on the

"track" story. The defense alms to
