R. Johnson, acting for several prominent citizens of the irrigation town to knock out the Incorporation of the city, says the Pendleton East Oreconlan. Mr. Johnson, and District Attorney O. W. Phelps will represent the state In the proceedings, while F. H. Bart lott and R. J. Slater will defend the city and Its officials. The complainants in the case will contend that the city was never legal ly incorporated. Insomuch a rte ac tion In granting the petition for Incor poration was taken by the county judge, sitting as court with the county commissioners, whereas, so It Is con tended, the county judge alone should have passed upon and decided the merits of the Incorporation petition. It will also be contended that the elec tion was Illegal Insomuch as the bal lots CHst were not of proper form, It Is claimed. Also, during the course of the pro ceedings, the plaintiff will probably bring up the question of the Hermts ton election of a year ago, alleging It to have been fraudulent, and to have, been conducted without regard to the election laws. On the other hand, the defense will contend that the city of Hermlston was legally and regularly organized, an election on the question of incor poration having been properly author laud, at which a majority of ballots cast were in favor of an incorporated town, and at which officers were duly and regularly elected. Leo McCoy was not there, neither was there any charge against him. This morning . Leo writes his mother to the effect" that ho has been In Spokane for the past month Leo's many friends here, as well as ihe friends of the family will be glad to learn that all of these reports have been without foundation.
