The hardest fight of the last session was over the proposed water code and the following from the Portland Journal Indicates that the fight is ot be, repeated at Sa lem next month: Most Important In Its possible ef fect upon the future development of Oregon pf all legislation which will come before the next session of the legislature, for enactment will be the Irrigation code now In course of draft ing. J. C. Bryant, representative-elect from Multnomah county, has the bill under consideration and is working In line with the ideas of State Engineer John H. Lewis, the expression of th Oregon State Grange, and the plans of the. Oregon commission for the con servation of the .natural resources of the state. Jui'kMon's Bill the Model. The new measure will be modeled along the general plan of the board of trade bill Introduced at the last ses sion of the legislature by Representa tive Perkins of Jackson county and defeated by a narrow margin after a bitter fight had been waged against It by the representatives of water power Interests In the house. . The primary idea of the proposed code Is that all waters within the state from all sources of water supply belong to the public and subject to existing rights to their use, may be appropriat ed for benefltcal use. ' Should Limit Permits. The main points being considered by Mr. Bryant are that the waters of the state belong to the1 people of tht state and can be used under certain restrictions for beneficial use, that va ters appropriated for Irrigation pur poses become appurtenant to the land; that water power permits given by the state to Individuals or , corporations should be limited to periods of 25 years, and that annual fees tp be fixed by the legislature should be charged for the use of power by corporations developing It; that all . water power corporations should be especially in corporated, and that no corporation shall be allowed to make application for a second power site until It has de veloped the Bite already held by It as a grant from the state; that full state menu of the construction and labor of all power plants shall be filed with the state engineer upon the completion of any project, and that the state shall reserve the right to buy, lease or con demn any works at the expiration ot ilia iei m ml ihe irmncmae or oeiore that time and the stae shall have the right and power to regulate the cost of heat, light and power, used by the state or by any Incorporated city or town. ' ' ' '' The great mass of litigation now (pending in the courts of the state over woter right shows clearly that there IS urgent, need In Oregon for remedial legislation. According to attorneys who have made wuter contest a spe cialty, there is no state in the union in which the water laws are la such chaos h In Oregon, under tue present taw about the only way by which the ter rights of the people In uny district taking their water from the same source could be adjudicated would be for t'U'iJ" Jjviaou hoiuing iuuu in tnai district to be made a party to a suit of determination, and even then the result would be uncertain. It is expected that the coming ses sion of the legislature will pass a wa ter codo bill, as thero has been a steadily growing demand for such, leg- Islntion. There was such a demand at the last session, but It was defeated by the persistent efforts of a few water power Interests. Mr. Bryant, as father of tho Irrigation code bill of the present session, will make Its success his prin cipal effort during the session.
