V The' first witness called was Dun. lap who, aside from the defendant, is the only eye witness. He was present and states in his evidence that he was sufficiently close that he could have placed his hands on both men. He told his story about as follows: Dunlap and Allen Johnson, the col ored boy who was killed, were herding sheep for a man by the name of Wllk shlre a few miles east of Telocaset. James Moore, who was In the same vicinity, was caring for a flock for Mitchell and saw the Wilkshire band coming, and met it several hundred yards before the two flocks could min gle. ' ,.'v r' . . Moore, after passing the time of day, requested Allen Johnson and Dunlap (the witness), to drive 'their sheep over another ridge, stating that his band was bedded along the trail In the heat pf the day and that he Could not move them. All three of the men then walked a few hundred feet, where they could view the-condition, and Dunlap asked Johnson, "What are we going to do about it?" Johnson replied, "I am going to take the sheep over that, trail." Moore Immediately stated, "If you do I will kill you." At that he slipped the rifle he had on his shoulder; Into position. Allen John son addressed him in foul language, with one hand In the air holding a siove. He stooned as If to rlU in n stick; thus advancing his body, but not his feet, Moore told him three times ; to come no closer. Johnson's left hand (he iwas left-handed) was on or near his hip-pocket, when Moore fired, killing him Instantly, the muz zle of the. rifle being about . one foot from Johnson's breast. Moore then returned to his sheep and drove them away and went to the authorities and gave himself up. , Johnson was dressed In a pair of corduroy pants, over which he wore a pair of bib overalls, and in his-left pocket was a pistol. The defense will try and make it self-defense, and the state, cold-blooded premeditated mur der. There will be many witnesses on both sides to prove character, pro and con. The defendant has lived In Union and Morrow counties for many years, a:i.. has many staunch friends.
