To provide for the sprinkling, cleaning and repairing of any or all the streets In said City, and In order to provide for the payment of the, expenses thereof, to levy a tax or special assessment upon the real property which shall be a Hen upon said property until paid. . House Moving; Dangerous Buildings. 89. To prevent the erection or moving of buildings within the City limits, which shall be dangerous to the passersby or to the adjacent property, or an obstruction to public travel, and in case any building or any public street shall become dangerous to passersby, the Council shall have power to cause the same to be removed or made safe at the expanse of the property, upon five days' notice to the owner thereof or agent therefor; and to determine by resolution when the same Is dangerous. Such expense shall be made a Hen upon the prop erty and shall be levied, assessed and collected In the same manner as assess ments for street improvements and the Council may regulate the time and manner of, and prohibit the removal of the buildings through the streets of the City, and may designate the character of buildings which may or may not be moved. .'' ' To allow, authorize, provide for and regulate the erection, mainte nance and removal of telegraph, telephone, electric light, electric railway, and other poles, wires and cables, and the laying and use of underground conduits or subways for the same, in, under! upon and over the streets, alleys or public parks, and public grounds of said City; and In, under, over and upon any lands owned, or under the control of the City, whether they be Inside the limits of said City or not; and to require all such wires and cables to be laid In said con duits or subways when reasonably, practicable. To provide for taking enumeration of the inhabitants of the City; to regulate the burial of the dead, and register of all births and deaths; to direct the returning' and keeping of all bills of mortality; and to Impose a penalty on physicians, sextons and others for default In the premises. t ' Compensation of Officers. : 48. The power and authority given to the Council by sub-division 23 of this Section can only be enforced or exercised by ordinance, unless otherwise expressly provided, and a majority of the Council may pass any ordinance or resolution not repugnant fo the Constitution und Laws of the United States or of the State of Oregon, necessary or convenient for carrying Into effect any power or authority granted by this Charter. t, CHAPTER VI. OF THE MAYOR HIS POWER AND DUTIES. General Duties. . - , Section 38. The Mayor Is the Chief Executive of the municipal corpora tion, and must exercise a careful supervision over its general affairs and sub ordinate officers. It Is hjs duty at the annual meeting of the Council, appointed oy tnis cnarter, to communicate by message to the. Council a general statement of the condition and affairs of the City, and to recommend the adoption ol such measures as he may deem expedient and proper and to make such special communications to the Council from time to time as he may think proper and useful. He shall have authority to preserve, order, enforce the rules of the Council and to determine the order of bu&lns subjc.V to such rules, and to appeal to the Council. Section 37. The Mayor shall take and approve all official undertakings which this Charter or the ordinances of the City may require any officer to give as security for the faithful performance of his duty, or any undertaking which may be required of any contractor for the faithful performance of hh contract; and when he approves such undertaking,. he must Immediately file the same with the City Recorder, excepting the undertaking of the City Re corder, of which he shall be the custodian. k Additional Dulles. Section 38. He shall perform such other duties and exercise such other authority as shall be prescribed by this Charter, or by any City ordinance, oi any law of the United States or of this State. Huhmltllnx Ordinance fur Approval; Proof In Courts. Section 39. No resolution or contract requiring the payment of money, nor any ordinance shall go Into force or be of any effect until approved and Blgned by the Major, except an provided in Section 40. Upon the passage of any ordinance or any resolution, the enrolled copy thereof, attested by, the Re corder, shall be submitted to the Mayor or President of the Council, by the Recorder, and If the Mayor approves the same, he shall write upon It "Ap proved." with the date thereof, and sign the same with the name of his office; and thereupon, unless otherwise provided herein, such ordinance or resolution shall become a law and be of force and effect; and in all Judicial proceedings, either In the Recorder's Court, or In any Court in this State, a copy of such ordinance or resolution, certified to by the Recorder, shall be competent evi dence of the provisions and passuge of such ordinance or resolution. Mayor s Veto; Return of Ordinance by Mayor. Section 40. It the Mayor does not approve any ordinance or resolution so submitted, he must, within five days Irom the receipt thereof, return th name to the City Recorder with his reasons for not approving It; and If the Mayor does not return It such ordinance or resolution shall become a law of If he had approved it. Passage Over Veto. Section 41. Upon the first regular meeting of the Council after the return of an ordinance or resolution from the Mayor not approved, the Recorder shall deliver the same a the Council with the message of the Mayor, which must be read; and such ordinance or resolution shall be put upon its passage again at said regular meeting or any ndjournirient thereof, and If three-fourths of ll members constituting the Council vote In the affirmative, It shall become a law without the approvul of the Mayor, and not otherwise. Comoynnce of Real Property. Section 42. All Instruments conveying real property belonging to said City shall be signed by the Mayor nnd attested by the City Recorder, and tht Seal of said City placed thereon, and shall be acknowledged and recorded as required by the General Law or the State, and no conveyance not thus executed acknowledged and recorded, shall have any uilldtty whatever as against said City. t CHAPTER VII. OP THE POWERS AND DUTIES OP OFFICERS. Recorder; Recorder's Court; Clerk or the Council. Section 43. The Recorder Is the judicial officer of the corporation, and hall hold Court therein at such a place us the Council shall provide, whlc' Court shall be known as the Recorder's Court: and he shall be elected and r his office os In the Charter hereinbefore provided. Section 4.V The Recorder shall make out and present to the Council n monthly statement of all moneys received or coflccted by him for the Cltv (ind or all licenses Issued and nil warrants drawn on the City treasury, and such other statements as the Council may require.
