A Welser dispatch to the Bols Cap ital News says: ' , .Edward, Hubbard, a veteran engi neer m the Oregon Short Lino, was acquitted yesterday of the charge of manslaughter preferred against ht" on account of the accidental killing of the little 4 ft -year-old son of Mr. and Mrs. Grlmfett, on June 12, when the boy was struck by an engine and killed-. Mr. Hubbard was engineer on the, second section' ot the. afternoon passenger 'train. ; The testimony showed that after the. first section' had passed, the grandmother permitted the, Jlttle boy .to . cross the track' after some cows. The distance to. the track was about MOO" yards from the bouse, and after the 'little fellow had crossed, the grandmother, seeing4 the second section coming, be came excited; and started toward the track screaming loudly.' ':' i , The prosecution contended that, the whistle was 'not sounded, thel bell rung or the proper look-out kept and the; boy's death was caused by, this failure. - '. f V'i." ' . ' ; 'I After the Impanelling of (he jury, most of whom were ranchmen 'from Mann's creek, the defense made the demand that the jury Inspect . the premises where the accident occurred. This was granted by the court and the Jury was conveyed to the place in a special car. The defense had the same engine that was run at the time of the accident and the Jury experi mented w(th it for two hours, giving an opportunity to see what chance the engineer had to see the boy, and also to Investigate other problems of the accident. After listening to the testimony, the Jury retired and on the first ballot reached a verdict of not guilty. A civil suit against the Short Line was commenced a few days after the ac cident asking for damages in the sum of $15,150. ' General Bowert and his partner, Mr. Ayres, represented the boys parents as plaintiffs.
