' All of the state's wit nesses except those In rebuttal have been summoned for today and the de fense's witnesses were also told to re port this afternoon. Testimony introduced this morning was along the samq line as at the last trial, except that it Is given more In sequence and the witnesses as they follow each other to the stand give a more connected story for the Jury to follow. The defense has followed the same tactics In cross-examination that It did hf ore. It Is elaborating some of the details regarding . Barnes' apparent carelessness the day he came back from the mountains alone, afbsr havt ing taken Mrs. Aldrlch up the road, and also on Barnes' many statements regardtctg his money. The record crowd of both trials, however, was last night, when the court room was simply packed. . . Seventeen witnesses were examined this morning for the state. Attorney Oscar Cain, who will un doubtedly take the lead when the de fense's witnesses get on the stand, was out of the city this morning, having been called to Pendleton on some le gal business. Bud Arts Insane. Bud Barnes made a play in court this afternoon to bear out his plea of Insanity and while the effort pasted almost unnoticed.
