The complaint differs from the original In that it asks that the court Issue an order restraining the sheriff from enforcing the provis ions of the prohibition law when the same goes Into effect July 1, With the exception of this one feat ure the amended complaint Is the same as the first one filed. The allegations of error on the part of the county court, sheriff and clerk are the same as In the first case. District Attorney Phelps Is now en gaged upon an answer to the new complaint ana says lie win o rtnttiy to file the same tomorrow after which the case will then be at. Issue." ' ' ' According to Mr. Phelps he will answer the complaint upon Its merits, denying all of the allegations made by the saloon men. In addition he will also have a demurrer prepared should he desire to use the same. However he says that he prefers to see the case go to trial at one upon the merits of the case so It Is possible he may not file a demurrer to the compliant. Should he file a demurrer and the court ssutain the same, the case would then be thrown out of court at once. However, the saloon men would again bring the subject up In a different manner. But it. the case Is tried out upon its merits now the proposition will be definitely settled, at least as far as the circuit court Is concerned. . Naittivilte Students Not Laggards. Those who remained away from the Deadwood theater last night, under the impression that the Nashville Stu dents might prove of the lets caliber of the Joyles Happy Hooligans, missed a treat. For light musical entertain' ment, with just the right sort of fun and dancing, the colored aggregation Is the best that . has been. . here. Throughout the evening the small cast of eight gave entire satisfaction, keep ing the large audience In an uproar of applause and appreciation over their work. They can each and every one sing and dance and act and the program was carefully culled of any thing that might prove objectionable or bordering on the vulgar. It was s clean and finished entertainment. W. A. Bruce and Miss L. Bruce, as sing ers, together with the Mitchells and Miss Henderson, were thoroughly en Joyed, Johnn;sjEdwards Is a rattling good eccentric dancer and a come dian, and George Boutte made the boards Jump with his shifty, new steps. The olio Is much above the average and contrary to most per formances of this kind, the audience Is better pleased as it progresses. Mr. Culllgan should be Justly proud if his company and It Is safe to say that the purses In town they visit should be flattered for their appear ance. Deadwood Pluneer-Tlmos.
