Is not a "freak" law it Is a fool law. There Is no correct principle In volved In referring a question of any kind to people for a final decision who do not know anything about Its merit and no possible defense of It can be made. At the election last week a new county was created from a portion of "Wasco, consisting of the Hood River valley, and under a new law In this late the potter was referred to all the people of Oregon to decide, wheth er It was a proper thing to do. It la an axiom which will not be disputed, The Tribune supposes, that' It la wrong to refer a question of Im portance to a Jury before whom there . In brief, the complaint re. cites: That the plaintiff, Julius Roesch. has for more than 20 years been en gaged In manufacturing beer In the city of La Grande, and his yearly In come Is not less than $40,000, of which amount not less than $8000 Is net profit, and that he now hM on hand at least 110,000 worth of malt, hops, etc., and plaintiff allege that the petition to the county court were Insuffitcent In that they were not-algn-ed by the requisite number of legal voters of Union county; that the coun ty court acted without Jurisdiction In making the order In submitting the question to the voters; that all the acts of the county clerk In connection with the election on the liquor question were Illegal, and thnt the sheriff. le gally posted notices nf the election only In the precincts of North Powder, the two Vnlon precincts.
