Hendricks repre sent the respondents. There are two cases arising out of the suit, but to day they were argued as one. The case of J. B. Ready, respond ent, vs. Henry Schmidt, Appellant, ap pealed from Wallowa county, was ar gued by J. A. Burleigh, for the re spondent, and O. N. Corklns for the appellant. The case of Starr vs. Starr was dis missed. The case of the Elgin Forwudlng Company v. F. M. Cummings, appel lant, was argued by J. W. Knowlea for the appellant and F. S. Ivanlioe for the respondent. All five of the court are present at the session today, as follows: Chief Justice R. S. Bean, Justices Moore, Eakln, Commissioner King and Com missioner Slater. J. C.
